The RFK Jr. vaccine policy controversy took a new turn this week as legal experts weighed in on his decision to transfer financial interest in vaccine-related lawsuits to a non-dependent adult son—a move made in response to questions raised during his confirmation process for Health and Human Services Secretary.
Robert F. Kennedy Jr., a longtime legal advocate in environmental and medical cases, faced scrutiny over his limited financial stake in lawsuits related to Merck’s Gardasil vaccine. While Kennedy initially declined to divest during public hearings, he later committed in writing to transfer any interest to his adult son—a step aimed at eliminating any potential conflict of interest if confirmed.
Critics argue the move doesn’t go far enough. Yet others point out that similar arrangements have been made by officials across administrations. “It is my opinion that RFK Jr.’s plan is more than sufficient to meet any ethical concerns,” said Hans von Spakovsky of the Heritage Foundation, citing the federally managed National Vaccine Injury Compensation Program that limits Kennedy’s influence over case outcomes.

Still, some legal analysts, including Manhattan Institute’s Jim Copland and Fox News contributor Andy McCarthy, expressed skepticism, noting that perceived indirect benefits can still raise red flags, especially for a Cabinet-level nominee.
