“Appeals court reinstates Trump tariffs”
A federal appeals court has issued a temporary stay on a lower court ruling that struck down former President Donald Trump’s “reciprocal” tariffs, allowing the measures to remain in effect while the legal challenge proceeds, CNBC reported Wednesday.
The stay was granted at the request of the White House, following a recent decision by the U.S. Court of International Trade (CIT), which found that the tariffs—part of what Trump referred to as the “Liberation Day” trade measures—exceeded presidential authority under the 1977 International Emergency Economic Powers Act (IEEPA).
The IEEPA grants the president broad powers to regulate international commerce during declared national emergencies. However, the CIT panel determined that the administration’s application of the statute in this context went beyond its intended scope.
Trump’s reciprocal tariff policy was designed to impose matching duties on countries that applied higher tariffs to U.S. exports, with the stated goal of leveling the playing field for American industries. The policy drew both praise from trade protection advocates and criticism from global trading partners and free market economists.
With the appeals court’s stay in place, the tariffs will remain active while the U.S. Court of Appeals for the Federal Circuit reviews the case.
The decision represents the latest development in an ongoing legal and political debate over presidential trade authority, executive use of emergency powers, and the broader implications of tariff-based economic strategy.
