“House Republican seeks prosecution of Andrew Cuomo”

House Oversight Committee Chairman James Comer has formally requested that the Department of Justice pursue prosecution against former New York Governor Andrew Cuomo for allegedly providing false statements to Congress during its investigation into New York’s management of nursing homes during the COVID-19 pandemic.
Comer, a Republican from Kentucky, alleges that Cuomo, a Democrat and current candidate in the New York City mayoral race, misrepresented his involvement in the state’s policies and reporting related to COVID-19 in elder care facilities. The claim builds on a prior referral made by former Representative Brad Wenstrup, then-chair of the now-dissolved House Select Subcommittee on the Coronavirus Pandemic, who also accused Cuomo of misleading congressional investigators. That referral was not acted upon by the Biden administration, but Comer’s renewed request suggests a potential shift under the current administration.
In a statement, Comer said Cuomo should be prosecuted “to the fullest extent of the law,” characterizing the former governor’s testimony as a “calculated cover-up” in connection with the 2020 directive that required nursing homes to accept COVID-19 positive patients.
A spokesperson for Cuomo, Rich Azzopardi, dismissed the referral, calling it “a meritless press release” and “an attempt at election interference and lawfare,” citing Department of Justice guidelines against using prosecutorial referrals for political purposes.
Cuomo, who rose to national prominence during the early months of the pandemic through his daily briefings, has maintained that the primary source of COVID-19 transmission in nursing homes was through community spread and staff infection, not hospital discharges. He also defended his role in the development of a New York State Department of Health report on nursing home fatalities, though House Republicans contend that Cuomo sought to alter that report to minimize political fallout.
The renewed scrutiny comes amid Cuomo’s effort to mount a political comeback in the Democratic primary for New York City mayor. The legacy of the state’s handling of nursing home deaths during the pandemic, along with prior sexual harassment allegations that led to his resignation in 2021, continues to shape public and political discourse around his candidacy.
Separately, the Trump administration has recently moved to drop federal corruption charges against current New York City Mayor Eric Adams—now running as an independent—after Adams agreed to cooperate with federal immigration enforcement at Rikers Island. Adams, who recently testified before Comer’s committee on immigration policy, received a notably favorable reception compared to other Democratic mayors present.
