Dr. Anthony Fauci repeatedly invoked his Fifth Amendment right against self-incrimination during a contentious Senate hearing Wednesday, refusing to answer more than 100 questions about the federal government’s handling of the COVID-19 pandemic and the origins of the coronavirus. The hearing, led by Sen. Rand Paul (R-Ky.), quickly became one of the most dramatic confrontations yet in the years-long battle over America’s pandemic response.

From his opening statement, Fauci made clear he would not participate in questioning. Acting on the advice of his attorneys, he argued that answering senators’ questions could expose him to future legal jeopardy, despite having received a preemptive pardon from former President Joe Biden before leaving office. Fauci accused Paul of conducting what he called an “unhinged obsession” aimed at finding grounds to prosecute him.

Throughout the hearing, Republican senators pressed Fauci on several issues that have fueled controversy since the pandemic began. Their questions focused on federal funding connected to research in Wuhan, China’s handling of the outbreak, shifting public health guidance on masks and lockdowns, and Fauci’s previous testimony before Congress regarding gain-of-function research.

Rather than respond, Fauci gave the same answer repeatedly:

“On the advice of counsel, I respectfully decline to answer based upon my rights under the Fifth Amendment.”

Rand Paul Threatens Contempt Vote

Committee Chairman Rand Paul argued that Fauci’s refusal to testify obstructed Congress’s investigation and announced he intends to pursue a committee vote on holding Fauci in contempt.

Paul has spent years questioning Fauci’s testimony regarding NIH funding and research involving the Wuhan Institute of Virology. During the hearing, Paul warned there would be “repercussions” for refusing to answer after being subpoenaed.

The hearing grew even more heated when Fauci’s attorney, David Schertler, attempted to address the committee after Paul’s questioning concluded. Paul repeatedly interrupted him before directing security to remove the attorney from the hearing room, creating one of the day’s most dramatic moments.

Democrats Call Hearing Political Theater

Democratic members of the committee defended Fauci, arguing Republicans were less interested in gathering facts than creating conditions for a criminal prosecution.

Sen. Gary Peters (D-Mich.) warned that turning Fauci into what he described as a political scapegoat could discourage qualified scientists from serving in future public health emergencies.

Other Democrats characterized the hearing as an attempt to relitigate pandemic disputes rather than uncover new evidence about COVID-19’s origins.

No New Evidence Emerges

Although anticipation surrounding the hearing was high, the proceedings produced little new factual information regarding the pandemic, the virus’s origin, or federal decision-making. Fauci’s decision to invoke the Fifth prevented senators from obtaining substantive testimony, leaving both sides to restate arguments they have made for years.

Republicans continued to argue that unanswered questions remain about government transparency, research funding, and the decisions that shaped lockdowns, school closures, and vaccine policy. Democrats countered that previous investigations have already examined many of those issues and criticized what they viewed as efforts to criminalize scientific disagreements.

More than six years after COVID-19 reshaped the country, Wednesday’s hearing demonstrated that the political battles surrounding the pandemic remain unresolved.

For Fauci’s critics, his repeated invocation of the Fifth Amendment will likely raise new questions about accountability. His supporters argue exercising a constitutional right should not be interpreted as an admission of wrongdoing, particularly when a witness believes testimony could be used to build future criminal cases.
