The U.S. Department of Justice has reportedly opened an investigation into former New York Governor Andrew Cuomo, following a referral from House Oversight Committee Chairman James Comer. The inquiry focuses on alleged false statements Cuomo made during congressional testimony regarding his administration’s handling of the COVID-19 pandemic, particularly surrounding nursing home deaths.
According to sources cited by The New York Times, the DOJ’s investigation began last month under then-acting U.S. Attorney for the District of Columbia Ed Martin. Both the DOJ and FBI have declined to comment on the matter or confirm the existence of an investigation.
Chairman Comer has publicly called for accountability over Cuomo’s role in shaping a New York State Health Department report that some critics say undercounted the number of nursing home deaths attributed to COVID-19. The report, released in July 2020, was widely scrutinized after state officials admitted in early 2021 that the initial figures did not include thousands of residents who died in hospitals after being transferred from long-term care facilities.
Cuomo’s spokesperson, Rich Azzopardi, questioned the timing and motives behind the reported investigation, especially as Cuomo prepares for a potential political comeback. The former governor is seeking the Democratic nomination in New York City’s upcoming mayoral race, with the primary election scheduled for next month. Incumbent Mayor Eric Adams is running as an independent.
“We have never been informed of any such matter, so why would someone leak it now?” Azzopardi told The Times. “The answer is obvious: This is lawfare and election interference plain and simple — something President Trump and his top Department of Justice officials say they are against.”
Azzopardi also stated that Cuomo is willing to testify before Congress again to clarify any previous statements. The investigation, if confirmed, adds to a complex political landscape as scrutiny continues over pandemic-era leadership decisions across multiple states and agencies.
The news follows a recent decision by the DOJ to dismiss separate corruption charges against Mayor Adams, who had been accused of accepting illegal donations from foreign interests, including individuals linked to the Turkish government.
At the time of publication, the Justice Department has neither confirmed nor denied whether former Governor Cuomo is officially under investigation. Cuomo resigned from office in August 2021 amid unrelated sexual harassment allegations, though he has since signaled his intent to return to public office.
