The definition of “disability” under the ADA and other federal statutes appears to fit exactly the condition of being unvaxxed. If so, discrimination (mandates, dismissals, exclusions, etc.) against the unvaxxed is contrary to law. The ADA defines a disability as (1) a physical or mental condition that substantially limits one or more major life activities; (2) a record (or past history) of such an condition; or (3) being regarded as having a physical or mental condition that substantially limits one or more major life activities. Not having a Covid vaccine’s ingredients and the resulting effects in one’s body is a physical condition of the body. Being unvaxxed limits one or more major life activities including working and other physical and mental activities because of the discriminatory measures themselves. On a more granular level, being unvaxxed limits, according to vaccine advocates, the body’s ability to fight a Covid infection, a major life activity.
