Biden’s Vaccine Mandate Crushed in Historic DOJ Settlement
In a major win for constitutional liberty, medical freedom, and federal workers across the country, Feds For Freedom has reached a historic settlement with the Department of Justice, bringing an end to nearly four years of legal warfare against the Biden administration’s COVID-19 vaccine mandate for federal employees.
The case—Feds For Medical Freedom, et al. v. Biden, et al.—challenged the Biden administration’s 2021 executive order requiring all federal employees and contractors to receive the COVID-19 vaccine or face termination. Now, thanks to the unrelenting work of volunteers, attorneys, and civil servants turned whistleblowers, the mandate has not only been defeated—it’s being wiped from the record.
“Our victory is a long-overdue confirmation of what we have asserted all along: COVID mandates were unconstitutional, immoral, and un-American,” said Marcus Thornton, President of Feds For Freedom. “Patriotic Americans proudly held the line against an unprecedented attack on our most basic freedoms.”
What the Settlement Delivers
The agreement is far more than symbolic. It brings concrete protections for federal employees who resisted the mandate and suffered retaliation or fear of reprisal:

Expungement of Vaccine Records: The Office of Personnel Management (OPM) must destroy all records of vaccine status, mandate noncompliance, or exemption requests—unless an employee chooses otherwise.

Ban on Vaccine-Based Discrimination: Federal agencies can no longer consider vaccine status or mandate defiance in any employment decisions—hiring, promotions, discipline, or termination.

Legal Fee Reimbursement: The government will pay a portion of Feds For Freedom’s legal expenses, a rare financial acknowledgment of the group’s legitimacy and impact.
Trent McCotter, partner at Boyden Gray PLLC, the legal firm representing the plaintiffs, stated:
“If it weren’t for Feds For Freedom and its patriotic members fighting back in 2022, today’s settlement would never have happened. It shows the Trump Administration is on our side and willing to help right those wrongs.”
How It Happened
After a dozen other legal efforts collapsed, Feds For Freedom filed suit in Texas in December 2021. In January 2022, they won a nationwide injunction—blocking Biden’s mandate from being enforced. That injunction held for over three years, outlasting the very administration that imposed it.
Despite immense political and bureaucratic pressure, federal employees, contractors, and volunteers held the line, funding their own defense and refusing to surrender to coercion.
Co-founder Jim Erdman reflected:
“If it weren’t for quiet professionals willing to speak up as every level of flaccid political and bureaucratic leadership failed a test of their humanity, we might have found ourselves in a very different country today.”
Holding the Line—and the Government Accountable
While the government denies wrongdoing, the terms of the settlement tell a different story: this is a tacit admission of harm. Feds For Freedom is already preparing to monitor compliance, demanding certificates of destruction and helping workers file FOIA and Privacy Act requests to ensure their data is truly erased.
“We would do it all again, just harder,” Erdman added—echoing the resilience that made this outcome possible.
