California’s AB 495: A Trojan Horse for State Control Over Your Children?

As California pushes forward with Assembly Bill 495, many freedom-minded Americans are sounding the alarm over what appears to be yet another sweeping expansion of state control over families and parental authority. Read the full bill on DailyClout’s BillCam. 

Officially titled the Family Preparedness Plan Act of 2025, AB 495 was introduced by Assembly Member Celeste Rodriguez under the guise of protecting children in immigrant households. But a closer look reveals the bill may do far more to empower bureaucrats and third-party caregivers than to protect families.


What’s Really Inside AB 495?

At first glance, the bill appears noble: prevent the trauma of family separation by enabling temporary guardianship and limiting immigration enforcement in schools and daycare facilities. But when you peel back the layers, you find a series of legal expansions that chip away at parental rights, private medical decisions, and local autonomy.

✅ Expanded Power for Non-Relatives

Under AB 495, nonrelative extended family members—including teachers, clergy, or even loosely affiliated family friends—are now granted legal rights to authorize medical care, mental health treatment, and school-based decisions for children. All it takes is a signature on an affidavit.

This means that a public school teacher could legally approve medical procedures for your child—even mental health treatments—so long as they’re deemed to have an “established relationship.” The bill insists that a parent’s authority prevails “unless it jeopardizes the child’s safety,” but who defines that? The state.

Confidential Court Proceedings Shielded from Oversight

The bill also locks guardianship proceedings behind closed doors—sealed from public view and, more disturbingly, from immigration authorities, regardless of context. This raises serious questions about transparency and accountability. If the state can appoint legal guardians without public scrutiny or notification of relevant agencies, what’s to stop abuse or ideological exploitation?


The Bigger Picture: Government Overreach Masquerading as Compassion

AB 495 goes far beyond helping immigrant families. It cements the state’s authority over how children are cared for, who makes decisions in their absence, and when parental rights can be superseded. This isn’t just about immigration—it’s about state-managed childrearing under the banner of “public safety.”

Here are more red flags:

  • Schools and day care centers are barred from asking about immigration status—but must comply with state-designed enforcement protocols.

  • New crimes are created for “false affidavits” and facility violations, increasing state reach into family and private care matters.

  • The Attorney General is empowered to create and enforce policies limiting federal enforcement—essentially overriding federal immigration law within state institutions.


Who Decides What’s Best for Your Child?

The core issue isn’t whether families should be protected from traumatic separations. It’s who has the authority to make decisions for children in a crisis. AB 495 increasingly gives that power to schools, courts, and state-licensed entities—not parents.

Freedom advocates argue that California’s track record shows this is not a fluke—it’s a pattern. From COVID-era lockdowns and vaccine mandates to education restrictions and parental consent battles, the Golden State is quietly becoming a testing ground for post-parental governance.


The Bottom Line

California AB 495 may be marketed as a compassionate reform, but its true effect is to normalize state intervention in the family unit—especially under the pretext of emergency, immigration, or public health.

If you value parental rights, medical freedom, and limited government, AB 495 should concern you. Once the state claims authority over who gets to raise, medicate, or make legal decisions for your child, liberty has already lost ground.
