RFK Jr. Vows to Overhaul Broken Vaccine Court
Health and Human Services Secretary Robert F. Kennedy Jr. has announced a sweeping plan to reform the Vaccine Injury Compensation Program (VICP), also known as the vaccine court, which was created to compensate individuals—especially children—injured by vaccines.
“The VICP is broken, and I intend to fix it,” Kennedy declared in a post on X. “I will not allow the VICP to continue to ignore its mandate and fail its mission of quickly and fairly compensating vaccine-injured individuals.”
The vaccine court operates using funds collected through a surcharge on every vaccine administered. Established in 1986 after vaccine manufacturers were granted immunity from liability, the VICP was intended to offer swift, fair compensation without the need for traditional litigation. But Kennedy says the program has veered far off course.
To date, the court has paid out over $5.4 billion to 12,000 petitioners, yet Kennedy says its structure favors bureaucrats and fund preservation over victims’ rights. “The VICP has devolved into a morass of inefficiency, favoritism, and outright corruption,” he wrote. “Government lawyers and Vaccine Court judges prioritize the solvency of the HHS Trust Fund over justice.”
Because the defendant is the U.S. government (not the vaccine makers), claimants are left fighting the vast legal power of the Department of Justice. Kennedy called out the inherent conflict of interest in this setup and promised to reform the system so it functions as Congress originally intended.
The announcement comes on the heels of another bold policy move by Kennedy—replacing the CDC’s Advisory Committee on Immunization Practices, the panel responsible for federal vaccine recommendations. That committee recently reversed its position on recommending flu shots containing thimerosal, a mercury-based preservative long criticized by public health advocates.
Kennedy’s reforms represent a significant shift in how the U.S. government treats vaccine regulation, signaling a renewed focus on transparency, accountability, and victims’ rights.
