Trump DOJ opens mortgage fraud probe into Eric Swalwell
The Department of Justice under President Donald Trump has launched an investigation into Rep. Eric Swalwell, D-Calif., over allegations of mortgage fraud, Fox News confirmed.
Swalwell responded that he was unsurprised to be targeted by Trump and vowed to continue speaking out while pursuing his lawsuit against the former president.
“As the most vocal critic of Donald Trump over the last decade—and the only person who still has an active lawsuit against him—the only thing that surprises me is that it took him this long to come after me,” Swalwell said.
“Like James Comey, John Bolton, Adam Schiff, Lisa Cook, Letitia James, and the many more who will follow, I refuse to live in fear in what was once the freest country in the world. Of course, I will continue my lawsuit, and I won’t stop speaking out for Californians,” he added, invoking Mark Twain’s line: ‘Patriotism is supporting your country all the time, and your government when it deserves it.’ “Mr. President, do better. Be better.”
The investigation, first reported by NBC News, centers on allegations that Swalwell secured millions in loans and refinancing by claiming his primary residence was in Washington, D.C., according to a source familiar with the referral. Bill Pulte, head of the Federal Housing Agency, reportedly sent Attorney General Pam Bondi a letter accusing Swalwell of potentially making false or misleading statements on loan documents.
According to NBC, the probe will examine possible mortgage fraud, as well as potential state and local tax or insurance violations. Fox News Digital has requested comment from the DOJ.
The developments surfaced the same day MSNBC reported that two sources say Swalwell is seriously considering a run for California governor, with one source suggesting he could announce as early as next week. Swalwell declined to comment on the report.
Swalwell—long one of Trump’s most outspoken critics—has also faced renewed scrutiny over what some watchdogs have called a “bizarre inconsistency” in Federal Election Commission filings. The filings show more than 75 payments since 2021 totaling over $360,000 to a Haitian American staffer, Darly Meyer, with varying explanations that include travel, car services, salary, reimbursements, and even event flowers.
The congressman’s campaign has also reported numerous expenses for luxury car services, upscale restaurants, and high-end hotels in cities such as Dubai, Berlin, Paris, and London.
Swalwell was also among the most vocal proponents of the claim that Donald Trump colluded with Russia. Those assertions were later contradicted by Special Counsel John Durham’s 2023 report, which concluded intelligence agencies lacked “actual evidence of collusion” when launching the Trump-Russia investigation—the same conclusion reached by Robert Mueller’s 2019 report, which found no criminal conspiracy.
