An Act To Amend Title 11 Of The Delaware Code Relating To Expungements. [HB-145]
This Bill makes the statutory scheme for expungement of adult criminal offenses more comprehensive in three areas. First, it applies the existing expungement rules to violations of county and municipal codes, ordinances, and regulations. By doing so, expungements of such violations will be simplified and require less Superior Court resources. Second, it applies the existing rules for the First Offenders Controlled Substance Diversion Program to court-supervised drug diversion programs, which is the means by which most minor drug offenders are diverted. An Act To Amend Titles 3 And 29 Of The Delaware Code Relating To The Licensing Of Video Lottery Casinos And Harness Racing Days. [HB-146]
This Act seeks to create jobs and new sources of revenue for the State by authorizing the addition of two new video lottery agents, one in Sussex County and one in New Castle County, through an application process conducted by a Lottery Economic Development Committee. This Act creates a nine-member, politically balanced Committee with financial, accounting, or banking experience to select the sites and licensees in a fair and open process. An Act To Amend Title 24 Of The Delaware Code Relating To Nursing. [HB-155]
This bill creates the option of renewing a nursing license late, up to sixty days past the renewal period consistent with most regulated professions. Currently, nurses who attempt to renew after their renewal date must apply for reinstatement which delays the process due to the criminal background check requirement. This bill eliminates the delay in the renewal process and potential interruption to patient care.

An Act To Amend Title 29 Of The Delaware Code Relating To The State Employees' Pension Plan. [HB-164]
This bill permits employees who are employed in positions that are classified as Hazardous Duty Level A-1 to retire at 25 years without any reduction. Those employees will pay a higher employee contribution rate. The bill is subject to a Private Letter Ruling by the Internal Revenue Service. If approved those employees would begin paying a higher contribution rate the first of the following year after the approval. Employees may begin to retire under this provision once they have been contributing under the new provisions for two years.

An Act To Amend Title 24 Of The Delaware Code Relating To The Medical Practice Act And The Board Of Medical Licensure And Discipline. [HB-165]
This bill clarifies that the duty of physicians and health care facilities to report under this paragraph is to report changes that result in the partial or full removal of a physician’s hospital privileges as the result of adverse events, unprofessional conduct or competency issues and not to report changes that enhance or add to the physician’s privileges.

An Act To Amend Title 30 Of The Delaware Code Relating To Commodity Taxes. [HB-178]
This bill eliminates the taxing disparity between moist snuff and “other tobacco products,” not including cigarettes. It also raises the tax rate from 15% to 68% of the wholesale price, and designates tax revenue over $3.5 million to The Delaware Health Fund. This bill does not affect taxes on cigarettes. An Act To Amend Title 14 Of The Delaware Code Relating To Contract Bidding And Free Public Schools. [HB-183]
The intent of this Act is to promote competitive bidding for public school contracts. Competitive bidding benefits the public school and the public, generally, as it promotes better quality bidding and, consequently, thereby promotes more efficient and economical use of public funds. An Act To Amend Title 6 Of The Delaware Code Relating To Commerce And Trade And The Safe Destruction Of Documents Containing Personal Identifying Information. [HB-194]
This bill will create a new chapter regarding the safe destruction by business entities of documents containing personal information. Aggrieved customers will have a civil action to recover potential treble damages. In addition, the Attorney General may file suit or bring an administrative enforcement proceeding against the business in violation if it is in the public interest. Banks, financial institutions, and certain other regulated institutions are exempt, as are governments and their subdivisions, agencies and instrumentalities.

An Act To Amend Title 11 And Title 29 Of The Delaware Code To Provide Post-retirement Increases To Pensioners And Change Actuarial Assumptions In The Judicial, State Police And State Employee Pension Plans. [HB-217]
Sections 1 – 3 of this Act grant pension increases to retired State Employees, retired Judges, retired “New” State police and retired County/Municipal Police/Firefighters on January 1, 2012 for persons retired on or before June 30, 2010. Sections 4 – 6 of this Act give the Board of Pension Trustees the authority to amend the growth rate in the State Employees’ pension plan, Judiciary pension plan, and the State Police pension plan.
