Explanation of Bill H.R. 7551

This bill aims to prohibit any Federal law from granting immunity or limiting liability for the manufacturer of a COVID-19 vaccine with regards to claims for loss caused by, arising out of, relating to, or resulting from the administration or use of the vaccine.

Key Points in the Bill

Section 1 - Short Title

This Act may be referred to as the "Let Injured Americans Be Legally Empowered Act" or the "LIABLE Act".

Section 2 - No Federal Immunity from, or Limitation on, Liability for Manufacturers for Loss Caused by a COVID-19 Vaccine

a) In General:

No Federal law, including specific sections mentioned in the Public Health Service Act, can grant the manufacturer of a COVID-19 vaccine immunity from lawsuits or limit their liability for claims of loss resulting from the vaccine's administration or use.

b) Rule of Construction:

This Act does not prohibit individuals from seeking compensation through existing compensation programs, such as the Countermeasures Injury Compensation Program or the National Vaccine Injury Compensation Program.

c) Relation to Other Programs:

An individual is not prevented from filing a civil lawsuit for claims described in subsection (a) even if they have sought or received compensation through the Countermeasures Injury Compensation Program or the National Vaccine Injury Compensation Program.

d) Definition:

The term "COVID-19 vaccine" refers to a vaccine that is authorized by the Food and Drug Administration to prevent, mitigate, or limit harm caused by COVID-19 or the transmission of the SARS-CoV-2 virus or its mutations.

e) Retroactive Applicability:

This Act applies regardless of whether the administration or use of a COVID-19 vaccine occurred before, on, or after the date of enactment of this Act.
