An Act To Amend Title 10 Of The Delaware Code Relating To Contractual Limitation Periods. [HB-363]
Delaware common law currently permits contracting parties to effectively opt into a 20 year limitations period by entering into a contract under seal. Absent compliance with the requirements for a contract under seal, the statute of limitations for breach of contract claims is generally three years or, in the case of contracts governed by Article 2 of the Delaware UCC, four years. An Act To Amend Chapter 38, Title 12 Of The Delaware Code Relating To The Creation, Regulation, Operation And Dissolution Of Domestic Statutory Trusts. [HB-364]
This bill makes the following changes to Delaware Statutory Trust Act (the “Act”) to keep it current and to maintain its national preeminence. The following is a section-by-section review of the proposed amendments of the Act. Section 1. This section amends 3803(d) of the Act to clarify that a defense of usury shall not apply to obligations of a beneficial owner or trustee of a statutory trust owed to a beneficial owner or trustee of a statutory trust when the obligations arise under the governing instrument or a separate agreement in writing. An Act To Amend Title 18 Of The Delaware Code Relating To Line-of-duty Death Benefits. [HB-372]
This Bill expands line of duty death benefits to include individuals who die from a heart attack, stroke, or vascular rupture within 24 hours of on duty strenuous physical activity. This Bill further removes the statute of limitations on submitting a claim for benefits. The Act shall be applied retroactively to include all claims for benefits for a death occurring on or after July 1, 2005. This Act shall be known as the Delaware Hometown Heroes Act.

An Act To Amend Titles 18 And 19 Of The Delaware Code Relating To Workers' Compensation Insurance. [HB-373]
This Act makes substantial changes to Titles 18 and 19 of the Delaware Code designed to control the level of workers’ compensation premiums in Delaware. An Act To Amend Title 18 Of The Delaware Code Relating To The Licensing And Regulation Of Limited Lines Travel Insurance Producers. [HB-379]
This bill modernizes the regulatory structure in Delaware for travel insurance to be in line with other states and the way that travel insurance is currently developed, marketed, and sold in the US. An Act To Amend Title 29 Of The Delaware Code Relating To The Jockeys Health And Welfare Benefit Board. [HB-38]
This bill changes the membership of the Jockeys Health and Welfare Benefit Board to include, among the six-member board, one active Delaware jockey and one retired Delaware jockey participating in the benefit program rather than two active Delaware jockeys. The Jockeys Health and Welfare Benefit Board administers the Delaware Jockeys Health and Welfare Benefit fund that provides health and other welfare benefits for active, disabled, and retired jockeys.

An Act To Amend Title 3 Of The Delaware Code Relating To Industrial Hemp. [HB-385]
Section 7606 of the federal Farm Bill exempts the growth and cultivation of industrial hemp for research purposes from the provisions of the federal Controlled Substances Act, the Safe and Drug-Free Schools and Communities Act, Chapter 81 of Title 41 of the United States Code, and any other Federal law so long as such growth and cultivation is also permitted under state law. This Bill authorizes the growth and cultivation of industrial hemp by the Department of Agriculture and higher education institutions for research purposes in the State of Delaware. An Act To Amend Title 16 Of The Delaware Code Relating To The Treatment Of Drug Overdose. [HB-388]
This bill would allow peace officers who have completed a DHSS approved training course to receive, carry, and administer the drug naloxone. Naloxone is a prescription drug which, when administered to a person undergoing an opioid related overdose, can have the effect of counteracting the effects of the overdose. Immunity is provided to officers who administer naloxone in good faith.
