Substitute House Bill No. 6531 - Public Act No. 21-34

AN ACT CONCERNING THE RIGHT TO COUNSEL IN EVICTION PROCEEDINGS, THE VALIDITY OF INLAND WETLANDS PERMITS IN RELATION TO CERTAIN OTHER LAND USE APPROVALS, AND EXTENDING THE TIME OF EXPIRATION OF CERTAIN LAND USE PERMITS.

This bill establishes a right to counsel program for income-eligible tenants, lessees, or occupants facing eviction. This program provides free legal representation to individuals who receive a notice to quit or are involved in a summary process action, as well as any administrative proceedings related to housing subsidies or lease terminations. Designated not-for-profit legal services organizations will provide this legal representation.

The bill also extends the expiration time for certain land use permits. Prior approvals made on or after July 1, 2011, but before the effective date of this bill, and did not expire prior to March 10, 2020, will now expire not less than 19 years after approval. This includes approvals for special permits, special exceptions, site plans, subdivisions, and permits related to inland wetlands.
