Explanation of Bill HB No. 3909
This bill aims to ensure that companies who hold a license under the Private Security Act are correctly classifying their employees. It prohibits companies from misclassifying employees as independent contractors, which is against federal guidelines. The bill requires the Department to verify the employment records of applicants before issuing or renewing a company license to confirm correct classification of employees.
These rules will only apply to applications submitted on or after the effective date of the Act, which is September 1, 2023.
