85R11711 SCL-D     By: Swanson H.B. No. 2349       A BILL TO BE ENTITLED   AN ACT   relating to the filing of a fetal death certificate after an   abortion.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter A, Chapter 171, Health and Safety   Code, is amended by adding Section 171.006 to read as follows:          Sec. 171.006.  FETAL DEATH CERTIFICATE REQUIRED. (a)  A   physician or physician's agent shall file a fetal death certificate   with the local registrar of the appropriate registration district   in accordance with Chapter 193 and department rules for each death   of an unborn child that occurs as a result of an abortion performed   by the physician regardless of the gestational age of the unborn   child at the time the abortion is performed.          (b)  The physician or physician's agent shall provide a copy   of the fetal death certificate to the woman on whom the abortion was   performed.          SECTION 2.  Section 171.006, Health and Safety Code, as   added by this Act, applies only to an abortion performed on or after   the effective date of this Act.          SECTION 3.  This Act takes effect September 1, 2017.
