ANALYSIS

 

This bill directs a private employer, postsecondary institution, or clinical site for educational programs to accept requests from employees or students for exemptions from vaccine mandates.  The bill also prohibits an employer from requiring any medical treatment that has been approved by the Food and Drug Administration only for emergency or experimental use.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to exemptions from vaccine mandates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Communicable Disease; Exemption from Vaccination Mandates.  Amend RSA 141-C by inserting after section 20-f the following new section:

141-C:20-g  Exemption from Vaccination Mandates; Private Employers, Postsecondary Educational Institutions, Clinical Sites for Educational Programs.  

I.  Any private employer, postsecondary institution, or institution that provides clinical sites for educational programs, that mandates vaccinations shall, upon an employee or student's request for a medical, religious, or conscientious objector exemption, grant such exemption.

II. The employee or student's written request shall simply state:  “I, (employee/student name), hereby submit a request for a medical, religious, or conscientious objector exemption from the mandated vaccinations.  [Employee/Student Signature and Date]” and it shall be granted.

III.  No employer shall mandate any medical treatment that is considered by the United States Food and Drug Administration in emergency use authorization status or an experimental product.

2  Effective Date.  This act shall take effect upon its passage.
