A bill to amend 1986 PA 268, entitled

"Legislative council act,"

(MCL 4.1101 to 4.1901) by adding section 115.

the people of the state of michigan enact:

Sec. 115. (1) Under the Michigan legislative state medal program established under section 113, the legislature may award the Michigan legislative medal of honor.

(2) The Michigan legislative medal of honor is the highest legislatively issued military award of this state. All of the following apply to the awarding of the medal:

(a) The medal may be awarded to a living or deceased service member who satisfies any of the following requirements:

(i) Was born in this state.

(ii) Was a resident of this state when the service member entered military service.

(iii) Died in this state.

(b) The medal must be awarded to a service member who voluntarily performs a deed of personal bravery or self-sacrifice involving risk of life that is so conspicuous as to clearly distinguish the service member for gallantry and intrepidity above the service member's comrades. Awarding of the medal must be determined in accordance with the standard of extraordinary merit. The medal may be awarded only on incontestable proof of performance of the deed.

(c) The legislature may award the medal by concurrent resolution. The legislature shall not, during a single regular session, award the medal to more than the following 2 individuals:

(i) One service member who served between January 1, 1836 and December 31, 1955.

(ii) One service member who served on or after January 1, 1956.

(d) Upon passage of the concurrent resolution described in subdivision (c), the speaker of the house of representatives and the senate majority leader shall award the medal in the presence of the legislator or legislators who sponsored the concurrent resolution and the representative and senator of the district where the individual being awarded the medal resides or last resided.

(e) If the legislature determines that a recommendation does not meet the standards for awarding the medal, the legislature may determine that the recommendation meets the standards for the Michigan legislative medal of valor under section 116.

(3) The council administrator, or his or her designee, shall submit 4 proposed designs for the medal to the speaker of the house of representatives and the senate majority leader. The speaker of the house of representatives and the senate majority leader shall determine the final design for the medal.

(4) As used in this section:

(a) "Medal" means the Michigan legislative medal of honor described in subsection (1).

(b) "Service member" means a member or former member of the state military establishment, another state's military establishment, or the United States Armed Forces.

(c) "United States Armed Forces" means the United States Army, Navy, Marine Corps, Air Force, Space Force, or Coast Guard, including the reserve components.

Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 101st Legislature are enacted into law:

(a) Senate Bill No.____ or House Bill No. 6121 (request no. 06162'22).

(b) Senate Bill No.____ or House Bill No. 6118 (request no. 06163'22).

(c) Senate Bill No.____ or House Bill No. 6120 (request no. 06165'22).
