An act to add Section 99174 to the Public Utilities Code, relating to public transit.

Existing law requires the airport manager of an airport operated by a city, county, city and county, or airport district that conducts commercial operations and that has more than one million enplanements a year, or upon new terminal construction or the replacement, expansion, or renovation of an existing terminal, to provide a room or other location at each airport terminal behind the airport security screening area for members of the public to express breast milk in private.
Existing law imposes various requirements on transit operators. operators and on buildings open to
the public.
This bill would state the intent of the Legislature to enact future legislation to expand access to lactation rooms in transit centers. require a multimodal transit station that has a public restroom and that commences operations or a renovation on or after January 1, 2021, to include a lactation room. To the extent the bill imposes additional duties on a local agency, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for
making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

SECTION 1. Section 99174 is added to the Public Utilities Code, to read:
99174. (a) For purposes of this section, the following definitions apply:
(1) “Lactation room” means a room or other location open to members of the public to express breast milk in private and that meets both of the following conditions:
(A) Includes, at a minimum, a chair and an electrical outlet.
(B) Is located outside of the confines of a public restroom.
(2) “Renovation” means the repurposing of more than 25 percent of the space in the transit station.
(3) “Transit station” means a rail or
light-rail station, ferry terminal, bus hub, or bus transfer station, as defined in Section 65460.1 of the Government Code.
(b) A multimodal transit station that has a public restroom and that commences operations or a renovation on or after January 1, 2021, shall include a lactation room.
SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
SECTION 1.
It is the intent of the Legislature to enact future legislation to expand access to lactation rooms in transit centers, including, but not limited to, regional train and bus stations.
