Florida Senate - 2020 SB 1106 By Senator Baxley 12-00659-20 20201106__ 1 A bill to be entitled 2 An act relating to universal changing places; creating 3 s. 553.5145, F.S.; defining terms; requiring certain 4 entities to install and maintain at least one 5 universal changing place at specified locations; 6 specifying requirements for a universal changing 7 place; providing applicability; providing an effective 8 date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 553.5145, Florida Statutes, is created 13 to read: 14 553.5145 Universal changing place.— 15 (1) As used in this section, the term: 16 (a) “Physical disability” means a condition of physical 17 incapacitation due to a developmental disability, organic brain 18 damage, or mental illness, or one or more physical or mental 19 limitations that restrict a person’s ability to perform the 20 normal activities of daily living. 21 (b) “Place of public accommodation” has the same meaning as 22 in section 106.5 of the Florida Accessibility Code for Building 23 Construction. 24 (c) “Professional office of a healthcare provider” has the 25 same meaning as in section 106.5 of the Florida Accessibility 26 Code for Building Construction. 27 (d) “Public building or facility” has the same meaning as 28 in section 106.5 of the Florida Accessibility Code for Building 29 Construction. 30 (e) “Universal changing place” means an enclosed family or 31 assisted-use toilet facility containing a powered, height 32 adjustable adult changing table that is either floor or wall 33 mounted with a safety rail and that can be used by a person of 34 either sex, with his or her care provider, if applicable,for 35 personal hygiene purposes. 36 (2) A person, private firm, organization, corporation, or 37 state or local government that operates a place of public 38 accommodation or public building or facility shall install and 39 maintain at least one universal changing place at each of the 40 following locations in a familyrestroom facility for persons of 41 either sex who have a physical disability: 42 (a) Places of exhibition or entertainment, which include 43 movie theaters, theaters, concert halls, sports arenas, and 44 stadiums. 45 (b) Shopping centers, shopping malls, or stores of at least 46 40,000 square feet. 47 (c) Places of public display or collection, which include 48 museums, libraries, and galleries. 49 (d) Places of recreation, which include parks, zoos, and 50 amusement parks. 51 (e) Places of education, which include elementary, 52 secondary, undergraduate, and postgraduate private or public 53 schools. 54 (f) Social service centers, which include senior centers 55 and homeless shelters. 56 (g) Public buildings or facilities, which include any state 57 or local government buildings, rest areas, and state parks. 58 (h) Stations used for public transportation, which include 59 airport terminals, depots, and bus stations. 60 (i) Professional offices of healthcare providers, which 61 include hospitals and rehabilitation centers. 62 (3)(a) The universal changing place must measure at least 8 63 feet by 10 feet, with adequate space for a wheelchair to 64 maneuver; be equipped with a powered, height-adjustable adult 65 changing table, a waste receptacle, a toilet, a lavatory, a soap 66 dispenser, and a paper towel dispenser; and comply with current 67 accessibility requirements of theAmericans with Disabilities 68 Act. 69 (b) The powered, height-adjustable adult changing table in 70 the universal changing place must: 71 1. Be able to lower to a height of no more than 8 inches 72 and raise to a height of no less than 34 inches; 73 2. Be at least 25 inches in width by 72 inches in length; 74 and 75 3. Support at least 350 pounds. 76 (c) The entrance to each universal changing place in the 77 family restroom facility must have accessible signage indicating 78 the location of the changing place. If aplace of public 79 accommodation or public building or facility has a central 80 directory, the owner must ensure that the central directory 81 indicates the location of the universal changing place. 82 (4) This section applies to any place of public 83 accommodation or public building or facility that is open to the 84 public and is either: 85 (a) Built on or after January 1, 2021. 86 (b) An existing place of public accommodation or public 87 building or facilitythatapplies for a building permit on or 88 after January 1, 2021, for a renovation of a main facility, not 89 including a parking garage, estimated to cost $15,000 or more. 90 Section 2. This act shall take effect July 1, 2020.
