HOUSE BILL No. 4595

     A bill to amend 1974 PA 57, entitled

 

"An act relating to the sport of racing and carrier pigeons;

authorizing the flying of such pigeons; and providing for

regulation thereof by cities, villages, townships, and counties,"

 

by amending section 2 (MCL 433.352).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2. (1) The department shall not issue a carrier pigeon

 

permit to the an owner of carrier pigeons who unless the owner

 

complies with all of the following requirements:

 

     (a) The keeping of carrier pigeons by the owner is in

 

compliance with the regulations and ordinances of the city,

 

village, township, or county in which the pigeons are located.

 

     (b) (a) The loft used by the owner is found on inspection to


be in compliance with regulations prescribed by the department, and

 

is maintained in a clean, and orderly condition, and is kept in

 

good repair.

 

     (c) (b) The construction of a loft used by the owner complies

 

with the building code regulations of the city, village, township,

 

or county in which it is erected.

 

     (2) The requirements of zoning regulations relating to

 

restrictions on the location of stables and poultry enclosures

 

shall not apply to a loft for which a permit has been issued.A

 

city, village, township, or county shall not enact an ordinance

 

that prohibits the keeping of carrier pigeons.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
