     A bill to amend 1965 PA 278, entitled

 

"An act to establish and regulate a state institution of higher

education known as Saginaw valley state university; and to fix the

membership and the powers of its governing board,"

 

by amending the title and section 5a (MCL 390.715a), as amended by

 

1987 PA 155.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

                                TITLE

 

     An act to establish and regulate a state institution of higher

 

education known as Saginaw valley state university; and Valley

 

State University; to fix the membership and the powers of its

 

governing board; to grant certain powers, duties, and authority to

 

public safety officers of Saginaw Valley State University; and to

 

prescribe penalties.

 

     Sec. 5a. (1) The board may establish a public safety

 

department and prescribe the powers and duties of the public safety


department and prescribe the conditions of employment of its public

 

safety officers. The public safety officers shall be are peace

 

officers of this state and shall have the authority of police

 

officers under the Michigan vehicle code, Act No. 1949 PA 300, of

 

the Public Acts of 1949, as amended, being sections MCL 257.1 to

 

257.923. of the Michigan Compiled Laws. The public safety officers

 

shall be are vested with the same powers and authority as deputy

 

sheriffs in the county where property of the board is situated, and

 

subject to subsection (4), shall enforce state law and the rules

 

and ordinances of the university.

 

     (2) The jurisdiction of public safety officers shall be is

 

limited to the property of the university and public property

 

running through or adjacent to the university.

 

     (3) The public safety officers shall must be required to meet

 

the training standards of the Michigan commission on law

 

enforcement officers training council act of 1965, Act No.

 

standards act, 1965 PA 203, of the Public Acts of 1965, as amended,

 

being sections MCL 28.601 to 28.616 of the Michigan Compiled

 

Laws.28.615.

 

     (4) Except for the investigation and action described in

 

subsection (5), public safety officers who are granted authority

 

under this section may only investigate first or second degree

 

murder, domestic violence, or crimes involving sexual violence or

 

contact, or assault with a weapon, in consultation with the campus

 

crime commission as provided in the campus crime investigation act.

 

     (5) A public safety officer who is granted authority under

 

this section shall notify the campus crime commission if in the


course of his or her employment the public safety officer receives

 

information that first or second degree murder, domestic violence,

 

or a crime involving sexual violence or contact, or assault with a

 

weapon, has occurred on property described under subsection (2). If

 

otherwise granted the authority under this act, a public safety

 

officer may conduct a preliminary investigation and take action on

 

the information before providing the notice required under this

 

subsection.

 

     (6) A public safety officer who willfully neglects to perform

 

the duty required under subsection (5) is guilty of a misdemeanor

 

punishable by imprisonment for not more than 90 days or a fine of

 

not more than $1,000.00, or both.

 

     (7) As used in this section, "domestic violence" means a

 

violation of section 81(2), (3), (4), or (5) of the Michigan penal

 

code, 1931 PA 328, MCL 750.81.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No.____ (request no.

 

05654'18 *) of the 99th Legislature is enacted into law.
