A bill to amend 1966 PA 346, entitled
"State housing development authority act of 1966,"
(MCL 125.1401 to 125.1499c) by adding chapter 3C.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
CHAPTER 3C
Sec. 59d. The state historic preservation office created in
Executive Order No. 2007-53 is established in the authority.
Sec. 59e. (1) In addition to its other duties, through
December 31, 2018, the state historic preservation office shall
review proposed changes to the exterior of a site owned by a
downtown development authority, or for which the acquisition,
rehabilitation, or demolition is financed by a downtown development
authority, and listed on the state register of historic sites or
the national register of historic places that is not located in a
local historic district created under the local historic districts
act, 1970 PA 169, MCL 399.201 to 399.215. The review shall be
conducted as described in 54 USC 306108 and the response shall be
forwarded to the downtown development authority not later than 30
days after the state historic preservation office receives the
referral for review. However, for proposed changes that provide for
the demolition of a structure, the downtown development authority
shall not proceed unless the review by the state historic
preservation office approves the demolition. If the state historic
preservation office does not approve the demolition, then the
downtown development authority may appeal the decision as provided
in this act in the same manner as for sites located within a local
historic district created under the local historic districts act,
1970 PA 169, MCL 399.201 to 399.215.
(2) As used in subsection (1), "downtown development
authority" means a downtown development authority created under
1975 PA 197, MCL 125.1651 to 125.1681.
