      A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

by amending sections 674, 675, 801, 803d, 803f, 805, and 811f

 

(MCL 257.674, 257.675, 257.801, 257.803d, 257.803f, 257.805, and

 

257.811f), section 674 as amended by 2000 PA 268, section 675 as

 

amended by 2018 PA 179, section 801 as amended by 2018 PA 656,

 

section 803d as amended by 2018 PA 62, section 803f as amended by

 

2018 PA 681, section 805 as amended by 2013 PA 82, and section

 

811f as amended by 2017 PA 234, and by adding section 68c.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 68c. "Totally disabled veteran" means a person who

 

 2  meets either of the following requirements:

 

 3        (a) Has been determined by the United States Department of

 

 4  Veterans Affairs to have a service-connected total or permanent

 


 1  total disability rating for compensation.

 

 2        (b) Has been determined to have a service-connected total or

 

 3  permanent total disability rating and is receiving disability

 

 4  retirement pay from a branch of the uniformed armed services.

 

 5        Sec. 674. (1) A vehicle shall must not be parked, except if

 

 6  necessary to avoid conflict with other traffic or in compliance

 

 7  with the law or the directions of a police officer or traffic-

 

 8  control device, in any of the following places:

 

 9        (a) On a sidewalk.

 

10        (b) In front of a public or private driveway.

 

11        (c) Within an intersection.

 

12        (d) Within 15 feet of a fire hydrant.

 

13        (e) On a crosswalk.

 

14        (f) Within 20 feet of a crosswalk, or if there is not a

 

15  crosswalk, then within 15 feet of the intersection of property

 

16  lines at an intersection of highways.

 

17        (g) Within 30 feet of the approach to a flashing beacon,

 

18  stop sign, or traffic-control signal located at the side of a

 

19  highway.

 

20        (h) Between a safety zone and the adjacent curb or within 30

 

21  feet of a point on the curb immediately opposite the end of a

 

22  safety zone, unless a different length is indicated by an

 

23  official sign or marking.

 

24        (i) Within 50 feet of the nearest rail of a railroad

 

25  crossing.

 

26        (j) Within 20 feet of the driveway entrance to a fire

 

27  station and on the side of a street opposite the entrance to a

 


 1  fire station within 75 feet of the entrance if properly marked by

 

 2  an official sign.

 

 3        (k) Alongside or opposite a street excavation or

 

 4  obstruction, if the stopping, standing, or parking would obstruct

 

 5  traffic.

 

 6        (l) On the roadway side of a vehicle stopped or parked at the

 

 7  edge or curb of a street.

 

 8        (m) Upon a bridge or other elevated highway structure or

 

 9  within a highway tunnel.

 

10        (n) At a place where an official sign prohibits stopping or

 

11  parking.

 

12        (o) Within 500 feet of an accident at which a police officer

 

13  is in attendance, if the scene of the accident is outside of a

 

14  city or village.

 

15        (p) In front of a theater.

 

16        (q) In a place or in a manner that blocks immediate egress

 

17  from an emergency exit conspicuously marked as an emergency exit

 

18  of a building.

 

19        (r) In a place or in a manner that blocks or hampers the

 

20  immediate use of an immediate egress from a fire escape

 

21  conspicuously marked as a fire escape providing an emergency

 

22  means of egress from a building.

 

23        (s) In a parking space clearly identified by an official

 

24  sign as being reserved for use by disabled persons that is on

 

25  public property or private property available for public use,

 

26  unless the individual is a disabled person as described in

 

27  section 19a or a totally disabled veteran as described in section

 


 1  68c, or unless the individual is parking the vehicle for the

 

 2  benefit of a disabled person or a totally disabled veteran. In

 

 3  order for the vehicle to be parked in the parking space the

 

 4  vehicle shall must display 1 of the following:

 

 5        (i) A certificate of identification or windshield placard

 

 6  issued under section 675 to a disabled person.

 

 7        (ii) A special registration plate issued under section 803d

 

 8  to a disabled person or a totally disabled veteran.

 

 9        (iii) A similar certificate of identification or windshield

 

10  placard issued by another state to a disabled person.

 

11        (iv) A similar special registration plate issued by another

 

12  state to a disabled person.

 

13        (v) A special registration plate to which a tab for persons

 

14  with disabilities is attached issued under this act.

 

15        (vi) A registration plate to which a tab for disabled

 

16  veterans issued under section 803f is attached.

 

17        (t) In a clearly identified access aisle or access lane

 

18  immediately adjacent to a space designated for parking by persons

 

19  with disabilities.

 

20        (u) On a street or other area open to the parking of

 

21  vehicles that results in the vehicle interfering with the use of

 

22  a curb-cut or ramp by persons with disabilities.

 

23        (v) Within 500 feet of a fire at which fire apparatus is in

 

24  attendance, if the scene of the fire is outside a city or

 

25  village. However, volunteer fire fighters responding to the fire

 

26  may park within 500 feet of the fire in a manner not to interfere

 

27  with fire apparatus at the scene. A vehicle parked legally

 


 1  previous to the fire is exempt from this subdivision.

 

 2        (w) In violation of an official sign restricting the period

 

 3  of time for or manner of parking.

 

 4        (x) In a space controlled or regulated by a meter on a

 

 5  public highway or in a publicly owned parking area or structure,

 

 6  if the allowable time for parking indicated on the meter has

 

 7  expired, unless the vehicle properly displays 1 or more of the

 

 8  items listed in section 675(8).

 

 9        (y) On a street or highway in such a way as to obstruct that

 

10  obstructs the delivery of mail to a rural mailbox by a carrier of

 

11  the United States postal service.Postal Service.

 

12        (z) In a place or in a manner that blocks the use of an

 

13  alley.

 

14        (aa) In a place or in a manner that blocks access to a space

 

15  clearly designated as a fire lane.

 

16        (2) A person shall not move a vehicle not owned by the

 

17  person into a prohibited area or away from a curb a distance that

 

18  makes the parking unlawful.

 

19        (3) A bus, for the purpose of taking on or discharging

 

20  passengers, may be stopped at a place described in subsection

 

21  (1)(b), (d), or (f) or on the roadway side of a vehicle illegally

 

22  parked in a legally designated bus loading zone. A bus, for the

 

23  purpose of taking on or discharging a passenger, may be stopped

 

24  at a place described in subsection (1)(n) if the place is posted

 

25  by an appropriate bus stop sign, except that a bus shall must not

 

26  stop at such a place if the stopping is specifically prohibited

 

27  by the responsible local authority, the state transportation

 


 1  department, or the director of the department of state police.

 

 2        (4) A person who violates this section is responsible for a

 

 3  civil infraction.

 

 4        Sec. 675. (1) Except as otherwise provided in this section

 

 5  and this chapter, a vehicle stopped or parked upon a highway or

 

 6  street shall must be stopped or parked with the wheels of the

 

 7  vehicle parallel to the roadway and within 12 inches of any curb

 

 8  existing at the right of the vehicle.

 

 9        (2) A local authority may by ordinance permit parking of a

 

10  vehicle on a 1-way roadway with the vehicle's left wheels

 

11  adjacent to and within 12 inches of any curb existing at the left

 

12  of the vehicle.

 

13        (3) A local authority may by ordinance permit angle parking

 

14  on a roadway, except that angle parking is not permitted on a

 

15  state trunk line highway unless authorized by the state

 

16  transportation department.

 

17        (4) The state transportation commission with respect to

 

18  state trunk line highways and a board of county road

 

19  commissioners with respect to county roads, acting jointly with

 

20  the director of the department of state police, may place signs

 

21  prohibiting or restricting the stopping, standing, or parking of

 

22  vehicles on a highway where, in the opinion of the officials as

 

23  determined by an engineering survey, the stopping, standing, or

 

24  parking is dangerous to those using the highway or where the

 

25  stopping, standing, or parking of vehicles would unduly interfere

 

26  with the free movement of traffic on the highway or street. The

 

27  signs shall must be official signs and a person shall not stop,

 


 1  stand, or park a vehicle in violation of the restrictions stated

 

 2  on the signs. The signs shall must be installed only after a

 

 3  proper traffic order is filed with the county clerk. Upon the

 

 4  application to the state transportation commission by a home rule

 

 5  city affected by an order, opportunity shall must be given to the

 

 6  city for a hearing before the state transportation commission,

 

 7  under the administrative procedures act of 1969, 1969 PA 306, MCL

 

 8  24.201 to 24.328, except when if an ordinance of the home rule

 

 9  city prohibits or restricts the parking of vehicles on a state

 

10  trunk line highway; when if the home rule city, by lawfully

 

11  authorized official action, requests the state transportation

 

12  department to prohibit or restrict parking on a state trunk line

 

13  highway; or when if the home rule city enters into a construction

 

14  agreement with the state transportation department providing for

 

15  the prohibition or restriction of parking on a state trunk line

 

16  highway during or after the period of construction. Traffic

 

17  control orders, so long as they affect parking upon a state trunk

 

18  line highway within the corporate limits of a home rule city, are

 

19  considered "rules" within the meaning of the administrative

 

20  procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328, and

 

21  upon application for a hearing by a home rule city, the

 

22  proceedings before the state transportation commission shall must

 

23  be considered a "contested case" within the meaning of that act.

 

24        (5) A disabled person may apply, on a form prescribed by the

 

25  secretary of state, for a serially numbered nontransferable

 

26  temporary or permanent windshield placard for the personal use of

 

27  the disabled person. An individual who has a religious objection

 


 1  to having a medical examination may personally apply at a branch

 

 2  office of the secretary of state for a serially numbered

 

 3  nontransferable temporary or permanent windshield placard for the

 

 4  personal use of the disabled individual. If it appears obvious

 

 5  that the individual has a qualifying disability, the individual

 

 6  is not required to present a medical statement attesting to the

 

 7  disability. The application for and the issuance of the serially

 

 8  numbered nontransferable temporary or permanent windshield

 

 9  placard is subject to all of the following:

 

10        (a) The secretary of state may issue to a disabled person

 

11  with a temporary disability a temporary windshield placard that

 

12  is valid for a period of not more than 6 months.

 

13        (b) The secretary of state may issue to a disabled person

 

14  with a permanent disability an original or renewal permanent

 

15  windshield placard that is valid for a period of not more than 4

 

16  years.

 

17        (c) An original or permanent windshield placard expires on

 

18  the disabled person's fifth birthday after the date of issuance.

 

19        (d) A renewal permanent windshield placard expires on the

 

20  disabled person's fourth birthday after the date of renewal.

 

21        (e) Except as otherwise provided in this subsection, not

 

22  more than 45 days immediately preceding the expiration of his or

 

23  her certificate or placard, a person holding a permanent

 

24  windshield placard may apply for a new or renewal placard as

 

25  provided in this section. However, if the person will be out of

 

26  state during the 45 days immediately preceding expiration of the

 

27  placard or for other good cause shown cannot apply for a placard

 


 1  within the 45-day period, the person may apply for a new or

 

 2  renewal placard not more than 6 months before the placard

 

 3  expires. A placard issued or renewed under this subdivision

 

 4  expires as provided in this subsection.

 

 5        (f) Upon application in the manner prescribed by the

 

 6  secretary of state for replacement of a lost, stolen, or

 

 7  destroyed placard described in this section, a disabled person or

 

 8  organization that provides specialized services to disabled

 

 9  persons may be issued a placard that in substance duplicates the

 

10  original certificate or placard for a fee of $10.00.

 

11        (g) A placard described in this section may be used by a

 

12  person other than the disabled person for the sole purpose of

 

13  transporting the disabled person. An organization that provides

 

14  specialized services to disabled persons may apply for and

 

15  receive a permanent windshield placard to be used in any motor

 

16  vehicle actually transporting a disabled person. If the

 

17  organization ceases to transport disabled persons, the placard

 

18  shall must be returned to the secretary of state for cancellation

 

19  and destruction.

 

20        (h) The secretary of state shall not issue a permanent

 

21  placard to an individual under this section unless that

 

22  individual has provided proof of Michigan residency.

 

23        (6) A disabled person or totally disabled veteran with a

 

24  certificate of identification, windshield placard, special

 

25  registration plates issued under section 803d, a special

 

26  registration plate issued under section 803f that has a tab for

 

27  persons with disabilities attached, a registration plate that has

 


 1  a tab for disabled veterans issued under section 803f attached, a

 

 2  certificate of identification or windshield placard from another

 

 3  state, or special registration plates from another state issued

 

 4  for persons with disabilities is entitled to courtesy in the

 

 5  parking of a vehicle. The courtesy shall relieve relieves the

 

 6  disabled person,the totally disabled veteran, or the person

 

 7  transporting the disabled person or totally disabled veteran from

 

 8  liability for a violation with respect to parking, other than in

 

 9  violation of this act. A local authority may by ordinance

 

10  prohibit parking on a street or highway to create a fire lane or

 

11  to provide for the accommodation of heavy traffic during morning

 

12  and afternoon rush hours, and the privileges extending to

 

13  veterans and physically disabled persons under this subsection do

 

14  not supersede that ordinance.

 

15        (7) Except as otherwise provided in subsection (20), an

 

16  application for an initial free parking sticker shall must

 

17  contain a certification by a physician, physician assistant,

 

18  certified nurse practitioner, or physical therapist licensed to

 

19  practice in this state attesting to the nature and estimated

 

20  duration of the applicant's disabling condition and verifying

 

21  that the applicant qualifies for a free parking sticker. An

 

22  individual who has a religious objection to having a medical

 

23  examination may personally apply at a branch office of the

 

24  secretary of state for an initial free parking sticker. If it

 

25  appears obvious that the individual is unable to do 1 or more of

 

26  the acts listed in subdivisions (a) to (d), the individual is not

 

27  required to present a certification by a physician, a physician

 


 1  assistant, a certified nurse practitioner, or a physical

 

 2  therapist attesting to the nature and estimated duration of the

 

 3  applicant's disabling condition or verifying that the applicant

 

 4  qualifies for a free parking sticker. The applicant qualifies for

 

 5  a free parking sticker if the applicant is a licensed driver and

 

 6  the physician, physician assistant, certified nurse practitioner,

 

 7  or physical therapist certifies or, if an individual is not

 

 8  required to have a certification by a physician, a physician

 

 9  assistant, a certified nurse practitioner, or a physical

 

10  therapist, it is obvious that the applicant is unable to do 1 or

 

11  more of the following:

 

12        (a) Manage, manipulate, or insert coins, or obtain tickets

 

13  or tokens in parking meters or ticket machines in parking lots or

 

14  parking structures, due to the lack of fine motor control of both

 

15  hands.

 

16        (b) Reach above his or her head to a height of 42 inches

 

17  from the ground, due to a lack of finger, hand, or upper

 

18  extremity strength or mobility.

 

19        (c) Approach a parking meter due to his or her use of a

 

20  wheelchair or other device.

 

21        (d) Walk more than 20 feet due to an orthopedic,

 

22  neurological, cardiovascular, or lung condition in which the

 

23  degree of debilitation is so severe that it almost completely

 

24  impedes the ability to walk.

 

25        (8) To be entitled to free parking in a metered space or in

 

26  a publicly owned parking structure or area, a vehicle must

 

27  properly display 1 of the following:

 


 1        (a) A windshield placard bearing a free parking sticker

 

 2  issued under this act.

 

 3        (b) A valid windshield placard issued by another state.

 

 4        (c) A certificate of identification issued by another state.

 

 5        (d) A license plate for persons with disabilities issued by

 

 6  another state.

 

 7        (e) A special registration plate with a tab for persons with

 

 8  disabilities attached issued by another state.

 

 9        (9) A vehicle that does not properly display 1 of the items

 

10  listed in subsection (8) is not entitled to free parking in a

 

11  metered parking space or in a publicly owned parking area or

 

12  structure, and the disabled person or vehicle operator shall pay

 

13  all parking fees and may be responsible for a civil infraction.

 

14        (10) Blindness that is not accompanied by an incapacity

 

15  described in subsection (7) does not entitle a person to a free

 

16  parking sticker.

 

17        (11) The secretary of state shall attach a free parking

 

18  sticker, in contrasting colors, to the windshield placard of a

 

19  person certified as having an incapacity described in subsection

 

20  (7).

 

21        (12) A windshield placard issued under this section shall

 

22  must be displayed on the interior rearview mirror of the vehicle

 

23  or, if there is no interior rearview mirror, on the lower left

 

24  corner of the dashboard while the vehicle is parked or being

 

25  parked by or under the direction of a disabled person pursuant to

 

26  this section.

 

27        (13) Upon conviction of an offense involving a violation of

 


 1  the special privileges conferred upon a holder of a windshield

 

 2  placard or free parking sticker, a magistrate or judge trying the

 

 3  case, as a part of any penalty imposed, may confiscate the

 

 4  windshield placard or free parking sticker and return the

 

 5  confiscated item or items to the secretary of state together with

 

 6  a certified copy of the sentence imposed. Upon receipt of a

 

 7  windshield placard or free parking sticker from a judge or

 

 8  magistrate, the secretary of state shall cancel and destroy the

 

 9  placard or sticker, and the disabled person to whom it was issued

 

10  shall not receive another placard or sticker until he or she

 

11  submits a completed application and presents a current medical

 

12  statement attesting to his or her condition. A law enforcement

 

13  officer who observes a misuse of a windshield placard or free

 

14  parking sticker may immediately confiscate the placard or sticker

 

15  and forward it with a copy of his or her report to the secretary

 

16  of state.

 

17        (14) A person who intentionally makes a false statement of

 

18  material fact or commits or attempts to commit a deception or

 

19  fraud on a medical statement attesting to a disability, submitted

 

20  in support of an application for a windshield placard, free

 

21  parking sticker, special registration plate, tab for disabled

 

22  veterans, or tab for persons with disabilities under this

 

23  section, section 803d, or section 803f, is guilty of a

 

24  misdemeanor punishable by a fine of not more than $500.00 or

 

25  imprisonment for not more than 30 days, or both.

 

26        (15) A person who commits or attempts to commit a deception

 

27  or fraud by 1 or more of the following methods is guilty of a

 


 1  misdemeanor punishable by a fine of not more than $500.00 or

 

 2  imprisonment for not more than 30 days, or both:

 

 3        (a) Using a windshield placard or free parking sticker

 

 4  issued under this section or by another state to provide

 

 5  transportation to a disabled person, if the person is not

 

 6  providing transportation to a disabled person.

 

 7        (b) Altering, modifying, or selling a windshield placard or

 

 8  free parking sticker issued under this section or by another

 

 9  state.

 

10        (c) Copying or forging a windshield placard or free parking

 

11  sticker described in this section or selling a copied or forged

 

12  placard or sticker described in this section. In the case of a

 

13  violation of this subdivision, the fine described in this

 

14  subsection shall must be not less than $250.00.

 

15        (d) Using a copied or forged windshield placard or free

 

16  parking sticker described in this section.

 

17        (e) Making a false statement of material fact to obtain or

 

18  assist an individual in obtaining a placard or sticker described

 

19  in this section, a special registration plate under section 803d,

 

20  or a special registration plate, tab for disabled veterans, or

 

21  tab for persons with disabilities under section 803f.

 

22        (f) Knowingly using or displaying a placard or sticker

 

23  described in this section that has been canceled by the secretary

 

24  of state.

 

25        (16) Except as otherwise provided in this section, a person

 

26  who violates this section is responsible for a civil infraction.

 

27        (17) The secretary of state may cancel, revoke, or suspend a

 


 1  windshield placard or free parking sticker under any of the

 

 2  following circumstances:

 

 3        (a) The secretary of state determines that a windshield

 

 4  placard or free parking sticker was fraudulently or erroneously

 

 5  issued.

 

 6        (b) The secretary of state determines that a person has made

 

 7  or is making an unlawful use of his or her windshield placard or

 

 8  free parking sticker.

 

 9        (c) The secretary of state determines that a check or draft

 

10  used to pay the required fee is not paid on its first

 

11  presentation and is not paid upon reasonable notice or demand or

 

12  that the required fee is paid by an invalid credit card.

 

13        (d) The secretary of state determines that the person is no

 

14  longer eligible to receive or use a windshield placard or free

 

15  parking sticker.

 

16        (e) The secretary of state determines that the owner has

 

17  committed an offense under this act involving a windshield

 

18  placard or free parking sticker.

 

19        (f) A person has violated this act and the secretary of

 

20  state is authorized under this act to cancel, revoke, or suspend

 

21  a windshield placard or free parking sticker for that violation.

 

22        (g) The secretary of state receives notice from another

 

23  state or foreign country that a windshield placard or free

 

24  parking sticker issued by the secretary of state has been

 

25  surrendered by the owner or seized in conformity with the laws of

 

26  that other state or foreign country or has been improperly used

 

27  or displayed in violation of the laws of that other state or

 


 1  foreign country.

 

 2        (18) Before a cancellation, revocation, or suspension under

 

 3  subsection (17), the person affected by that action shall must be

 

 4  given notice and an opportunity to be heard.

 

 5        (19) A windshield placard issued to a disabled person shall

 

 6  must bear the first letter and the last 3 digits of the disabled

 

 7  person's driver or chauffeur's license number or official state

 

 8  personal identification card number.

 

 9        (20) For purposes of this section only, the secretary of

 

10  state may accept an application for a windshield placard, special

 

11  registration plate, or free parking sticker from a disabled

 

12  person that is signed by a physician, physician assistant,

 

13  certified nurse practitioner, or physical therapist licensed or

 

14  certified to practice in another state if the application is

 

15  accompanied by a copy of that physician's, physician assistant's,

 

16  certified nurse practitioner's, or physical therapist's current

 

17  medical license or certification issued by that state.

 

18        (21) This section does not require new or additional third

 

19  party reimbursement or worker's compensation benefits for

 

20  services rendered.

 

21        (22) As used in this section, "disabled person" means a

 

22  person who is determined by a physician, a physician assistant, a

 

23  physical therapist, or an optometrist as specifically provided in

 

24  this section licensed to practice in this state to have 1 or more

 

25  of the following physical characteristics:

 

26        (a) Blindness as determined by an optometrist, a physician,

 

27  or a physician assistant.

 


 1        (b) Inability to walk more than 200 feet without having to

 

 2  stop and rest.

 

 3        (c) Inability to do both of the following:

 

 4        (i) Use 1 or both legs or feet.

 

 5        (ii) Walk without the use of a wheelchair, walker, crutch,

 

 6  brace, prosthetic, or other device, or without the assistance of

 

 7  another person.

 

 8        (d) A lung disease from which the person's forced expiratory

 

 9  volume for 1 second, when measured by spirometry, is less than 1

 

10  liter, or from which the person's arterial oxygen tension is less

 

11  than 60 mm/hg of room air at rest.

 

12        (e) A cardiovascular condition that causes the person to

 

13  measure between 3 and 4 on the New York heart classification

 

14  scale, or that renders the person incapable of meeting a minimum

 

15  standard for cardiovascular health that is established by the

 

16  American Heart Association and approved by the department of

 

17  public health.

 

18        (f) An arthritic, neurological, or orthopedic condition that

 

19  severely limits the person's ability to walk.

 

20        (g) The persistent reliance upon an oxygen source other than

 

21  ordinary air.

 

22        Sec. 801. (1) The Except as otherwise provided in this act,

 

23  the secretary of state shall collect the following taxes at the

 

24  time of registering a vehicle, which shall exempt exempts the

 

25  vehicle from all other state and local taxation, except the fees

 

26  and taxes provided by law to be paid by certain carriers

 

27  operating motor vehicles and trailers under the motor carrier

 


 1  act, 1933 PA 254, MCL 475.1 to 479.42; the taxes imposed by the

 

 2  motor carrier fuel tax act, 1980 PA 119, MCL 207.211 to 207.234;

 

 3  and except as otherwise provided by this act:

 

 4        (a) For a motor vehicle, including a motor home, except as

 

 5  otherwise provided, and a pickup truck or van that weighs not

 

 6  more than 8,000 pounds, except as otherwise provided, according

 

 7  to the following schedule of empty weights:

26        On October 1, 1983, and October 1, 1984, the tax assessed

 

27  under this subdivision shall must be annually revised for the

 


 1  registrations expiring on the appropriate October 1 or after that

 

 2  date by multiplying the tax assessed in the preceding fiscal year

 

 3  times the personal income of Michigan for the preceding calendar

 

 4  year divided by the personal income of Michigan for the calendar

 

 5  year that preceded that calendar year. In performing the

 

 6  calculations under this subdivision, the secretary of state shall

 

 7  use the spring preliminary report of the United States Department

 

 8  of Commerce or its successor agency. A passenger motor vehicle

 

 9  that has been modified with a permanently installed wheelchair

 

10  lift mechanism or with permanently installed hand controls and

 

11  that is owned by an individual who uses a wheelchair or by an

 

12  individual who transports a member of his or her household who

 

13  uses a wheelchair and for which registration plates are issued

 

14  under section 803d shall 803d(1) must be assessed at the rate of

 

15  50% of the tax provided for in this subdivision. As used in this

 

16  subdivision, "permanently installed hand controls" means a

 

17  permanently installed device designed to replace the brake and

 

18  gas pedals of a motor vehicle with hand controls.

 

19        (b) For a trailer coach attached to a motor vehicle, the tax

 

20  shall must be assessed as provided in subdivision (l). A trailer

 

21  coach not under 1959 PA 243, MCL 125.1035 to 125.1043, and while

 

22  located on land otherwise assessable as real property under the

 

23  general property tax act, 1893 PA 206, MCL 211.1 to 211.155, if

 

24  the trailer coach is used as a place of habitation, and whether

 

25  or not permanently affixed to the soil, is not exempt from real

 

26  property taxes.

 

27        (c) For a road tractor, modified agricultural vehicle,

 


 1  truck, or truck tractor owned by a farmer and used exclusively in

 

 2  connection with a farming operation, including a farmer hauling

 

 3  livestock or farm equipment for other farmers for remuneration in

 

 4  kind or in labor, but not for money, or used for the

 

 5  transportation of the farmer and the farmer's family, and not

 

 6  used for hire, 74 cents per 100 pounds of empty weight of the

 

 7  road tractor, truck, or truck tractor. If the road tractor,

 

 8  modified agricultural vehicle, truck, or truck tractor owned by a

 

 9  farmer is also used for a nonfarming operation, the farmer is

 

10  subject to the highest registration tax applicable to the nonfarm

 

11  use of the vehicle but is not subject to more than 1 tax rate

 

12  under this act.

 

13        (d) For a road tractor, truck, or truck tractor owned by a

 

14  wood harvester and used exclusively in connection with the wood

 

15  harvesting operations or a truck used exclusively to haul milk

 

16  from the farm to the first point of delivery, 74 cents per 100

 

17  pounds of empty weight of the road tractor, truck, or truck

 

18  tractor. A registration secured by payment of the tax prescribed

 

19  in this subdivision continues in full force and effect until the

 

20  regular expiration date of the registration. As used in this

 

21  subdivision:

 

22        (i) "Wood harvester" includes the person or persons hauling

 

23  and transporting raw materials in the form produced at the

 

24  harvest site or hauling and transporting wood harvesting

 

25  equipment. Wood harvester does not include a person or persons

 

26  whose primary activity is tree-trimming or landscaping.

 

27        (ii) "Wood harvesting equipment" includes all of the

 


 1  following:

 

 2        (A) A vehicle that directly harvests logs or timber,

 

 3  including, but not limited to, a processor or a feller buncher.

 

 4        (B) A vehicle that directly processes harvested logs or

 

 5  timber, including, but not limited to, a slasher, delimber,

 

 6  processor, chipper, or saw table.

 

 7        (C) A vehicle that directly processes harvested logs or

 

 8  timber, including, but not limited to, a forwarder, grapple

 

 9  skidder, or cable skidder.

 

10        (D) A vehicle that directly loads harvested logs or timber,

 

11  including, but not limited to, a knuckle-boom loader, front-end

 

12  loader, or forklift.

 

13        (E) A bulldozer or road grader being transported to a wood

 

14  harvesting site specifically for the purpose of building or

 

15  maintaining harvest site roads.

 

16        (iii) "Wood harvesting operations" does not include the

 

17  transportation of processed lumber, Christmas trees, or processed

 

18  firewood for a profit making venture.

 

19        (e) For a hearse or ambulance used exclusively by a licensed

 

20  funeral director in the general conduct of the licensee's funeral

 

21  business, including a hearse or ambulance whose owner is engaged

 

22  in the business of leasing or renting the hearse or ambulance to

 

23  others, $1.17 per 100 pounds of the empty weight of the hearse or

 

24  ambulance.

 

25        (f) For a vehicle owned and operated by this state, a state

 

26  institution, a municipality, a privately incorporated, nonprofit

 

27  volunteer fire department, or a nonpublic, nonprofit college or

 


 1  university, $5.00 per plate. A registration plate issued under

 

 2  this subdivision expires on June 30 of the year in which new

 

 3  registration plates are reissued for all vehicles by the

 

 4  secretary of state.

 

 5        (g) For a bus including a station wagon, carryall, or

 

 6  similarly constructed vehicle owned and operated by a nonprofit

 

 7  parents' transportation corporation used for school purposes,

 

 8  parochial school or society, church Sunday school, or any other

 

 9  grammar school, or by a nonprofit youth organization or nonprofit

 

10  rehabilitation facility; or a motor vehicle owned and operated by

 

11  a senior citizen center, $10.00, if the bus, station wagon,

 

12  carryall, or similarly constructed vehicle or motor vehicle is

 

13  designated by proper signs showing the organization operating the

 

14  vehicle.

 

15        (h) For a vehicle owned by a nonprofit organization and used

 

16  to transport equipment for providing dialysis treatment to

 

17  children at camp; for a vehicle owned by the civil air patrol,

 

18  Civil Air Patrol, as organized under 36 USC 40301 to 40307,

 

19  $10.00 per plate, if the vehicle is designated by a proper sign

 

20  showing the civil air patrol's Civil Air Patrol's name; for a

 

21  vehicle owned and operated by a nonprofit veterans center; for a

 

22  vehicle owned and operated by a nonprofit recycling center or a

 

23  federally recognized nonprofit conservation organization; for a

 

24  motor vehicle having a truck chassis and a locomotive or ship's

 

25  body that is owned by a nonprofit veterans organization and used

 

26  exclusively in parades and civic events; for an emergency support

 

27  vehicle used exclusively for emergencies and owned and operated

 


 1  by a federally recognized nonprofit charitable organization; or

 

 2  for a vehicle owned and operated by a nonprofit food pantry or

 

 3  nonprofit food bank, $10.00 per plate.

 

 4        (i) For each truck owned and operated free of charge by a

 

 5  bona fide ecclesiastical or charitable corporation, or Red Cross,

 

 6  Girl Scout, or Boy Scout organization, 65 cents per 100 pounds of

 

 7  the empty weight of the truck.

 

 8        (j) For each truck, weighing 8,000 pounds or less, and not

 

 9  used to tow a vehicle, for each privately owned truck used to tow

 

10  a trailer for recreational purposes only and not involved in a

 

11  profit making profit-making venture, and for each vehicle

 

12  designed and used to tow a mobile home or a trailer coach, except

 

13  as provided in subdivision (b), $38.00 or an amount computed

 

14  according to the following schedule of empty weights, whichever

26        For each commercial vehicle registered under this

 

27  subdivision or section 801g, $15.00 shall must be deposited in a


 

 1  truck safety fund to be expended as provided in section 25 of

 

 2  1951 PA 51, MCL 247.675.

 

 3        If a truck tractor or road tractor without trailer is leased

 

 4  from an individual owner-operator, the lessee, whether an

 

 5  individual, firm, or corporation, shall pay to the owner-operator

 

 6  60% of the tax prescribed in this subdivision for the truck

 

 7  tractor or road tractor at the rate of 1/12 for each month of the

 

 8  lease or arrangement in addition to the compensation the owner-

 

 9  operator is entitled to for the rental of his or her equipment.

 

10        (l) For each pole trailer, semitrailer, trailer coach, or

 

11  trailer, the tax shall must be assessed according to the

17        The registration plate issued under this subdivision expires

21  trailers, a person who has once paid the tax as increased by 2003

 

22  PA 152 for a vehicle under this subdivision is not required to

 

23  pay the tax for that vehicle a second time, but is required to

 

24  pay only the cost of the reissued plate at the rate provided in

 2  annual October 1 revisions but is in addition to the tax assessed

 

 3  as a result of the annual October 1 revisions. Beginning January

 

 4  1, 1984 and ending February 18, 2019, $3.00 of each motorcycle

 

 5  fee shall must be placed in a motorcycle safety fund in the state

 

 6  treasury and shall must be used only for funding the motorcycle

 

 7  safety education program as provided for under sections 312b and

 

 8  811a. Beginning February 19, 2019, $5.00 of each motorcycle fee

 

 9  shall must be placed in the motorcycle safety fund and shall must

 

10  be used only for funding the motorcycle safety education program

 

11  as provided for under sections 312b and 811a.

 

12        (o) For each truck weighing 8,001 pounds or more, road

 

13  tractor, or truck tractor used exclusively as a moving van or

 

14  part of a moving van in transporting household furniture and

 

15  household effects or the equipment or those engaged in conducting

 

16  carnivals, at the rate of 80% of the schedule of elected gross

 

17  weights in subdivision (k) as modified by the operation of that

 

18  subdivision.

 

19        (p) After Except as otherwise provided in this section,

 

20  after September 30, 1983, each motor vehicle of the 1984 or a

 

21  subsequent model year as shown on the application required under

 

22  section 217 that has not been previously subject to the tax rates

22        For a vehicle of the 1984 or a subsequent model year that

 

23  has been previously registered by a person other than the person

 

24  applying for registration or for a vehicle of the 1984 or a

 

25  subsequent model year that has been previously registered in

 

26  another state or country and is registered for the first time in

 

27  this state, the tax under this subdivision shall be is determined


 

 1  by subtracting the model year of the vehicle from the calendar

 

 2  year for which the registration is sought. If the result is zero

 

 3  or a negative figure, the first registration tax shall must be

 

 4  paid. If the result is 1, 2, or 3 or more, then, respectively,

 

 5  the second, third, or subsequent registration tax shall must be

 

 6  paid. A passenger motor vehicle that has been modified with a

 

 7  permanently installed wheelchair lift mechanism or with

 

 8  permanently installed hand controls and that is owned by an

 

 9  individual who uses a wheelchair or by an individual who

 

10  transports a member of his or her household who uses a wheelchair

 

11  and for which registration plates are issued under section 803d

 

12  shall 803d(1) must be assessed at the rate of 50% of the tax

 

13  provided for in this subdivision. As used in this subdivision,

 

14  "permanently installed hand controls" means a permanently

 

15  installed device designed to replace the brake and gas pedals of

 

16  a motor vehicle with hand controls.

 

17        (q) For a wrecker, $200.00.

 

18        (r) When the secretary of state computes a tax under this

 

19  act, a computation that does not result in a whole dollar figure

 

20  shall must be rounded to the next lower whole dollar when if the

 

21  computation results in a figure ending in 50 cents or less and

 

22  shall must be rounded to the next higher whole dollar when if the

 

23  computation results in a figure ending in 51 cents or more,

 

24  unless specific taxes are specified, and the secretary of state

 

25  may accept the manufacturer's shipping weight of the vehicle

 

26  fully equipped for the use for which the registration application

 

27  is made. If the weight is not correctly stated or is not


 

 1  satisfactory, the secretary of state shall determine the actual

 

 2  weight. Each application for registration of a vehicle under

 

 3  subdivisions (j) and (m) shall must have attached to the

 

 4  application a scale weight receipt of the vehicle fully equipped

 

 5  as of the time the application is made. The scale weight receipt

 

 6  is not necessary if there is presented with the application a

 

 7  registration receipt of the previous year that shows on its face

 

 8  the weight of the motor vehicle as registered with the secretary

 

 9  of state and that is accompanied by a statement of the applicant

 

10  that there has not been a structural change in the motor vehicle

 

11  that has increased the weight and that the previous registered

 

12  weight is the true weight.

 

13        (s) For a private passenger motor vehicle that has a special

 

14  registration plate issued under section 803d(2) or 803f or a tab

 

15  for disabled veterans issued under section 803f, no tax shall be

 

16  assessed under this section. As used in this subdivision,

 

17  "private passenger motor vehicle" means a motor vehicle that is

 

18  personally owned by the disabled veteran and is used for the

 

19  primary purpose of transporting the disabled veteran and family

 

20  members of the disabled veteran, but does not include a motor

 

21  home.

 

22        (2) A manufacturer is not exempted under this act from

 

23  paying ad valorem taxes on vehicles in stock or bond, except on

 

24  the specified number of motor vehicles registered. A dealer is

 

25  exempt from paying ad valorem taxes on vehicles in stock or bond.

 

26        (3) Until October 1, 2019, the tax for a vehicle with an

 

27  empty weight over 10,000 pounds imposed under subsection (1)(a)


 

 1  and the taxes imposed under subsection (1)(c), (d), (e), (f),

 

 2  (i), (j), (m), (o), and (p) are each increased as follows:

 

 3        (a) A regulatory fee of $2.25 that shall must be credited to

 

 4  the traffic law enforcement and safety fund created in section

 

 5  819a and used to regulate highway safety.

 

 6        (b) A fee of $5.75 that shall must be credited to the

 

 7  transportation administration collection fund created in section

 

 8  810b.

 

 9        (4) Except as otherwise provided in this subsection, if a

 

10  tax required to be paid under this section is not received by the

 

11  secretary of state on or before the expiration date of the

 

12  registration plate, the secretary of state shall collect a late

 

13  fee of $10.00 for each registration renewed after the expiration

 

14  date. An application for a renewal of a registration using the

 

15  regular mail and postmarked before the expiration date of that

 

16  registration shall must not be assessed a late fee. The late fee

 

17  collected under this subsection shall must be deposited into the

 

18  general fund. The secretary of state shall waive the late fee

 

19  collected under this subsection if all of the following are

 

20  satisfied:

 

21        (a) The registrant presents proof of storage insurance for

 

22  the vehicle for which the late fee is assessed that is valid for

 

23  the period of time between the expiration date of the most recent

 

24  registration and the date of application for the renewal.

 

25        (b) The registrant requests in person at a department of

 

26  state branch office that the late fee be waived at the time of

 

27  application for the renewal.


 

 1        (5) In addition to the registration taxes under this

 

 2  section, the secretary of state shall collect taxes charged under

 

 3  section 801j and credit revenues to a regional transit authority

 

 4  created under the regional transit authority act, 2012 PA 387,

 

 5  MCL 124.541 to 124.558, minus necessary collection expenses as

 

 6  provided in section 9 of article IX of the state constitution of

 

 7  1963. Necessary collection expenses incurred by the secretary of

 

 8  state under this subsection shall must be based upon an

 

 9  established cost allocation methodology.

 

10        (6) This section does not apply to a historic vehicle.

 

11        (7) Beginning January 1, 2017, the registration fee imposed

 

12  under this section for a vehicle using 4 or more tires is

 

13  increased as follows:

 

14        (a) If the vehicle is a hybrid electric vehicle, the

 

15  registration fee for that vehicle is increased by $30.00 for a

 

16  vehicle with an empty weight of 8,000 pounds or less, and $100.00

 

17  for a vehicle with an empty weight of more than 8,000 pounds. As

 

18  used in this subdivision and subsection (8)(a), "hybrid electric

 

19  vehicle" means a vehicle that can be propelled at least in part

 

20  by electrical energy and uses a battery storage system of at

 

21  least 4 kilowatt-hours, but is also capable of using gasoline,

 

22  diesel fuel, or alternative fuel to propel the vehicle.

 

23        (b) If the vehicle is a nonhybrid electric vehicle, the

 

24  registration fee for that vehicle is increased by $100.00 for a

 

25  vehicle with an empty weight of 8,000 pounds or less, and $200.00

 

26  for a vehicle with an empty weight of more than 8,000 pounds. As

 

27  used in this subdivision and subsection (8)(b), "nonhybrid


 

 1  electric vehicle" means a vehicle that is propelled solely by

 

 2  electrical energy and that is not capable of using gasoline,

 

 3  diesel fuel, or alternative fuel to propel the vehicle.

 

 4        (8) Beginning January 1, 2017, if the tax on gasoline

 

 5  imposed under section 8 of the motor fuel tax act, 2000 PA 403,

 

 6  MCL 207.1008, is increased above 19 cents per gallon, the

 

 7  secretary of state shall increase the fees collected under

 

 8  subsection (7) as follows:

 

 9        (a) For a hybrid electric vehicle, $2.50 per each 1 cent

 

10  above 19 cents per gallon.

 

11        (b) For a nonhybrid electric vehicle, $5.00 per each 1 cent

 

12  above 19 cents per gallon.

 

13        (9) As used in this section:

 

14        (a) "Alternative fuel" means that term as defined in section

 

15  151 of the motor fuel tax act, 2000 PA 403, MCL 207.1151.

 

16        (b) "Diesel fuel" means that term as defined in section 2 of

 

17  the motor fuel tax act, 2000 PA 403, MCL 207.1002.

 

18        (c) "Gasoline" means that term as defined in section 3 of

 

19  the motor fuel tax act, 2000 PA 403, MCL 207.1003.

 

20        (d) "Gross proceeds" means that term as defined in section 1

 

21  of the general sales tax act, 1933 PA 167, MCL 205.51, and

 

22  includes the value of the motor vehicle used as part payment of

 

23  the purchase price as that value is agreed to by the parties to

 

24  the sale, as evidenced by the signed agreement executed under

 

25  section 251.

 

26        (e) "List price" means the manufacturer's suggested base

 

27  list price as published by the secretary of state, or the


 

 1  manufacturer's suggested retail price as shown on the label

 

 2  required to be affixed to the vehicle under 15 USC 1232, if the

 

 3  secretary of state has not at the time of the sale of the vehicle

 

 4  published a manufacturer's suggested retail price for that

 

 5  vehicle, or the purchase price of the vehicle if the

 

 6  manufacturer's suggested base list price is unavailable from the

 

 7  sources described in this subdivision.

 

 8        (f) "Purchase price" means the gross proceeds received by

 

 9  the seller in consideration of the sale of the motor vehicle

 

10  being registered.

 

11        Sec. 803d. (1) A disabled person may make application apply

 

12  to the secretary of state and the secretary of state may shall

 

13  issue,upon proper application, special registration plates

 

14  inscribed with the official international wheelchair symbol or a

 

15  reasonable facsimile of that symbol and special identification

 

16  numbers. Vehicles registered under section 801(1)(a) may be

 

17  issued special registration plates under this section.

 

18  subsection. A vehicle that is used to transport disabled persons

 

19  may qualify for these distinguishing plates when if the

 

20  registered owner of the vehicle resides at the same address as

 

21  the disabled person, submits as part of his or her application

 

22  for the plates a statement to the effect that the vehicle is used

 

23  for that purpose, and provides the secretary of state with a

 

24  medical statement attesting to the fact that the person being

 

25  transported is a disabled person. The fees for the special

 

26  registration plates under this subsection shall correspond with

 

27  the registration fees provided in section 801(1)(a). Application


 

 1  for the special registration plates shall under this subsection

 

 2  must be on a form prescribed by the secretary of state.

 

 3        (2) A person who is a totally disabled veteran with an

 

 4  honorable discharge from the armed services may apply to the

 

 5  secretary of state if he or she owns a private passenger motor

 

 6  vehicle, and the secretary of state shall issue for that private

 

 7  passenger motor vehicle, upon proper application, a special

 

 8  registration plate described in subsection (1). Application for

 

 9  the special registration plate under this subsection must be on a

 

10  form prescribed by the secretary of state and must be accompanied

 

11  by a service fee of $5.00 and proof that the applicant was

 

12  honorably discharged from the armed services and either one of

 

13  the following:

 

14        (a) That the applicant has been determined by the United

 

15  States Department of Veterans Affairs to have a service-connected

 

16  total or permanent total disability rating for compensation.

 

17        (b) That the applicant has been determined to have a

 

18  service-connected total or permanent total disability rating and

 

19  is receiving disability retirement pay from a branch of the

 

20  uniformed armed services.

 

21        (3) As part of a penalty imposed for violation of the

 

22  special privileges conferred by this section, a magistrate or

 

23  judge may order the special plates confiscated and returned to

 

24  the secretary of state together with a certified copy of the

 

25  sentence imposed. The use of special plates on a vehicle other

 

26  than the vehicle for which the plates are issued or by a person

 

27  who does not qualify under this section is a misdemeanor.


 

 1        (4) (2) As used in this section, "disabled section:

 

 2        (a) "Disabled person" means a person who is determined by a

 

 3  physician, a physician assistant, a physical therapist, or an

 

 4  optometrist as specifically provided in this section licensed to

 

 5  practice in this state to have 1 or more of the following

 

 6  physical characteristics:

 

 7        (i) (a) Blindness as determined by an optometrist, a

 

 8  physician, or a physician assistant.

 

 9        (ii) (b) Inability to walk more than 200 feet without having

 

10  to stop and rest.

 

11        (iii) (c) Inability to do both of the following:

 

12        (A) (i) Use 1 or both legs or feet.

 

13        (B) (ii) Walk without the use of a wheelchair, walker,

 

14  crutch, brace, prosthetic, or other device, or without the

 

15  assistance of another person.

 

16        (iv) (d) A lung disease from which the person's forced

 

17  expiratory volume for 1 second, when measured by spirometry, is

 

18  less than 1 liter, or from which the person's arterial oxygen

 

19  tension is less than 60 mm/hg of room air at rest.

 

20        (v) (e) A cardiovascular condition that causes the person to

 

21  measure between 3 and 4 on the New York heart classification

 

22  scale, or that renders the person incapable of meeting a minimum

 

23  standard for cardiovascular health that is established by the

 

24  American heart association Heart Association and approved by the

 

25  department of public health and human services.

 

26        (vi) (f) An arthritic, neurological, or orthopedic condition

 

27  that severely limits the person's ability to walk.


 

 1        (vii) (g) The persistent reliance upon an oxygen source other

 

 2  than ordinary air.

 

 3        (b) "Private passenger motor vehicle" means a motor vehicle

 

 4  that is personally owned by the disabled veteran and is used for

 

 5  the primary purpose of transporting the disabled veteran and

 

 6  family members of the disabled veteran, but does not include a

 

 7  motor home.

 

 8        Sec. 803f. (1) A person who is a totally disabled veteran

 

 9  with an honorable discharge from the armed services may make an

 

10  application apply to the secretary of state if he or she owns a

 

11  private passenger motor vehicle, and the secretary of state may

 

12  shall issue for that private passenger motor vehicle, upon proper

 

13  application, a special registration plate inscribed with special

 

14  identification numbers preceded by the letters "DV" and the words

 

15  "disabled veteran" inscribed beneath the registration number. For

 

16  the purposes of As used in this section, "private passenger motor

 

17  vehicle" means a motor vehicle that is personally owned by the

 

18  disabled veteran and is used for the primary purpose of

 

19  transporting the disabled veteran and family members of the

 

20  disabled veteran, but does not include a motor home.

 

21        (2) Application for the special registration plate must be

 

22  on a form prescribed by the secretary of state and must be

 

23  accompanied by a service fee of $5.00 and proof that the

 

24  applicant was honorably discharged from the armed services and

 

25  either 1 of the following:

 

26        (a) That the applicant has been determined by the United

 

27  States Department of Veterans Affairs to have a service-connected


 

 1  total or permanent total disability rating for compensation.

 

 2        (b) That the applicant has been determined to have a

 

 3  service-connected total or permanent total disability rating and

 

 4  is receiving disability retirement pay from a branch of the

 

 5  uniformed armed services.

 

 6        (3) A special registration issued under this section is

 

 7  exempt from payment of the tax provided in section 801.

 

 8        (4) The special registration plate expires on the birthday

 

 9  of the disabled veteran in a year in which new plates are issued

 

10  by the secretary of state. Application for renewal of the special

 

11  registration plate must be accompanied by a $5.00 service fee.

 

12  The applicant shall is not be required to furnish the proof

 

13  provided in subsection (2).

 

14        (5) The surviving spouse of a person who is a totally

 

15  disabled veteran with an honorable discharge from the armed

 

16  services may use a special registration plate issued under this

 

17  section after the death of the totally disabled veteran and may

 

18  renew a special registration plate issued under this section

 

19  after the death of the totally disabled veteran in the same

 

20  manner as provided under this section for a totally disabled

 

21  veteran. If applicable, a surviving spouse shall apply for

 

22  registration of the vehicle upon which he or she wishes to place

 

23  the disabled veteran plate before using or renewing the plate as

 

24  described in this section.

 

25        (6) The secretary of state may issue to a disabled person

 

26  who has been issued a special registration plate under this

 

27  section a tab for persons with disabilities. The tab for persons


 

 1  with disabilities must be an adhesive tab displaying the

 

 2  international wheelchair symbol or a reasonable facsimile of that

 

 3  symbol. The tab for persons with disabilities may be attached

 

 4  only to the special registration plate issued to the disabled

 

 5  person under this section.

 

 6        (6) (7) An application for a tab for persons with

 

 7  disabilities shall be on a form prescribed by the secretary of

 

 8  state. The secretary of state shall require the same proof that

 

 9  the applicant is a disabled person as is required for issuance of

 

10  a permanent windshield placard under section 675. If the

 

11  surviving spouse of a totally disabled veteran is a disabled

 

12  person, he or she may apply to the secretary of state for a tab

 

13  for persons with disabilities. in the same manner as provided for

 

14  a totally disabled veteran under this subsection.The tab for

 

15  persons with disabilities must be an adhesive tab displaying the

 

16  international wheelchair symbol or a reasonable facsimile of that

 

17  symbol. An application for a tab for persons with disabilities

 

18  must be on a form prescribed by the secretary of state. The

 

19  secretary of state shall require the same proof that the

 

20  surviving spouse is a disabled person as is required for issuance

 

21  of a permanent windshield placard under section 675. The tab for

 

22  persons with disabilities may be attached only to the special

 

23  registration plate issued under this section.

 

24        (7) (8) The tab for persons with disabilities must be issued

 

25  free of charge.

 

26        (8) (9) When If a disabled person surviving spouse who has

 

27  been issued a tab for persons with disabilities renews his or her


 

 1  the special registration plate issued under this section, the

 

 2  secretary of state shall issue a new tab for persons with

 

 3  disabilities to the disabled person, surviving spouse, free of

 

 4  charge. The disabled person shall surviving spouse is not be

 

 5  required to again furnish the proof required under subsection

 

 6  (7).(6).

 

 7        (9) The secretary of state shall issue, upon request, a tab

 

 8  for disabled veterans to a disabled veteran who has a private

 

 9  passenger motor vehicle for which a special registration plate is

 

10  or has been issued under this section or section 803d(2). The

 

11  disabled veteran is not required to again furnish the proof

 

12  required under this section or section 803d(2). The tab for

 

13  disabled veterans must be an adhesive tab displaying the letters

 

14  "DV".

 

15        (10) The secretary of state shall issue, upon proper

 

16  application, a tab for disabled veterans to a totally disabled

 

17  veteran with an honorable discharge from the armed services who

 

18  has a private passenger motor vehicle for which a registration

 

19  plate is or has been issued under another section of this act

 

20  other than section 803d(2).

 

21        (11) Application for the tab for disabled veterans must be

 

22  on a form prescribed by the secretary of state and must be

 

23  accompanied by proof that the applicant was honorably discharged

 

24  from the armed services and either 1 of the following:

 

25        (a) That the applicant has been determined by the United

 

26  States Department of Veterans Affairs to have a service-connected

 

27  total or permanent total disability rating for compensation.


 

 1        (b) That the applicant has been determined to have a

 

 2  service-connected total or permanent total disability rating and

 

 3  is receiving disability retirement pay from a branch of the

 

 4  uniformed armed services.

 

 5        (12) The secretary of state shall issue a tab for disabled

 

 6  veterans for not more than 1 private passenger motor vehicle of

 

 7  the disabled veteran.

 

 8        (13) The tab for disabled veterans may be attached only to

 

 9  the registration plate for which it was issued.

 

10        (14) Notwithstanding anything to the contrary in this act, a

 

11  registration issued under another section of this act for which a

 

12  tab for disabled veterans is issued under this section is exempt

 

13  from payment of the tax provided in section 801. However, the

 

14  registration remains subject to any fees or other charges

 

15  required under this act for the issuance, renewal, duplication,

 

16  replacement, or transfer of the registration plate.

 

17        (15) If a registration plate for which a tab for disabled

 

18  veterans has been issued is renewed, the secretary of state shall

 

19  issue a new tab for disabled veterans to the disabled veteran,

 

20  free of charge. The disabled veteran is not required to again

 

21  furnish the proof required under this section.

 

22        (16) (10) The use of the special registration plate, or a

 

23  tab for persons with disabilities, or a tab for disabled veterans

 

24  on a motor vehicle other than the motor vehicle for which the

 

25  special registration plate or tab is issued, or by a person who

 

26  does not qualify under this section, is a misdemeanor.

 

27        Sec. 805. (1) An applicant for the issuance or renewal of a


 

 1  motor vehicle registration or for a replacement registration tab

 

 2  or sticker may submit a state park and state-operated public

 

 3  boating access site passport fee to the secretary of state with

 

 4  the application. Subject to subsection (7), the amount of the

 

 5  recreation passport fee is as follows:

 

 6        (a) Except as provided in subdivision (b), $10.00.

 

 7        (b) For a motorcycle, $5.00.

 

 8        (2) In addition to the requirements of section 217, an

 

 9  application for a motor vehicle registration shall must contain

 

10  at least the following information, in substantially the

 

11  following format and language, except that the amount of the

 

12  recreation passport fee specified shall must be $5.00 for a

 

13  motorcycle:

 

 

14

$[Amount] Annual vehicle registration or renewal.

15

$10.00    Annual authorization to use this vehicle for

16

            unlimited entry into all Michigan state parks

17

            and recreation areas and DNR-operated state

18

            boating access sites. (Check one of the

19

            boxes below.)

20

            ____ I elect to pay this $10.00 fee.

21

            ____ I elect not to pay this $10.00 fee.

22

            This vehicle will not be used to enter the

23

            facilities described above.

24

25        (3) The secretary of state may revise the format and

 

26  language of an application for motor vehicle registration to

 


 1  reflect the fact that, under sections 74116 and 78119 of the

 

 2  natural resources and environmental protection act, 1994 PA 451,

 

 3  MCL 324.74116 and 324.78119, payment of the recreation passport

 

 4  fee authorizes entry into all state parks and recreation areas

 

 5  and designated state-operated public boating access sites until

 

 6  expiration of the motor vehicle registration.

 

 7        (4) If the applicant applies by mail and, in addition to the

 

 8  registration fee, the applicant pays an amount equal to the

 

 9  recreation passport fee, the applicant shall must be considered

 

10  to have elected to pay the recreation passport fee regardless of

 

11  whether such an election is indicated on the application.

 

12        (5) Subsections (1) and (2) do not apply to any of the

 

13  following:

 

14        (a) An application submitted by a dealer under section 217

 

15  for a vehicle sold, leased, or exchanged by the dealer.

 

16        (b) The issuance or renewal of a motor vehicle registration

 

17  described in section 803e(1) and exempt under section 803e(6)

 

18  from the registration tax, the issuance or renewal of a motor

 

19  vehicle registration for which a tab for disabled veterans is or

 

20  has been issued under section 803f, or the issuance or renewal of

 

21  a motor vehicle registration described in section 217d or 803f.

 

22        (6) The secretary of state shall, at least monthly, transfer

 

23  the revenue from recreation passport fees to the department of

 

24  natural resources and environment for deposit as provided in

 

25  section 2045 of the natural resources and environmental

 

26  protection act, 1994 PA 451, MCL 324.2045.

 

27        (7) For each calendar year, the state treasurer shall adjust

 


 1  the amounts set forth in subsection (1) by an amount determined

 

 2  by the state treasurer to reflect the cumulative percentage

 

 3  change in the consumer price index Consumer Price Index from

 

 4  October 1, 2010 to the October 1 immediately preceding that

 

 5  calendar year, using the most recent data available and rounded

 

 6  to the nearest dollar.

 

 7        (8) The legislature shall annually review the amount of

 

 8  revenue raised by the recreation passport fee to ensure that the

 

 9  amount is appropriate for the purposes for which the recreation

 

10  passport fee is assessed and in compliance with law.

 

11        (9) If the secretary of state issues a registration tab or

 

12  sticker for a registration plate or personalized registration

 

13  plate under section 224 or 803b for a motor vehicle for which a

 

14  recreation passport fee has been paid under this section, the tab

 

15  or sticker shall must be marked in a distinctive manner

 

16  determined by the secretary of state after consultation with the

 

17  director of the department of natural resources and the

 

18  department of state police. Before discontinuing the issuance of

 

19  a registration tab or sticker, the secretary of state shall

 

20  consult with the director of the department of natural resources

 

21  and establish an alternative method or procedure by which the

 

22  department of natural resources can determine whether a

 

23  recreation passport fee has been paid for a motor vehicle.

 

24        (10) Whether or not an individual paid or indicated that he

 

25  or she elected to pay or not to pay a recreation passport fee

 

26  under this section is personal information for purposes of

 

27  section 40b.

 


 1        (11) As used in this section:

 

 2        (a) "Consumer price index" Price Index" means the most

 

 3  comprehensive index of consumer prices available for this state

 

 4  from the bureau of labor statistics of the United States

 

 5  department of labor.Bureau of Labor Statistics of the United

 

 6  States Department of Labor.

 

 7        (b) "Motor vehicle" does not include a commercial motor

 

 8  vehicle.

 

 9        (c) "Recreation passport fee" means the state park and

 

10  state-operated public boating access site recreation passport fee

 

11  as provided for in subsection (1).

 

12        Sec. 811f. (1) The secretary of state may, upon application,

 

13  issue 1 fund-raising plate instead of a standard registration

 

14  plate to a person for use on a passenger motor vehicle, motor

 

15  home, pickup truck, or van.

 

16        (2) A person may be issued a fund-raising plate for use on a

 

17  vehicle under this act by applying to the secretary of state

 

18  under section 217. The applicant must accompany an application

 

19  for an original fund-raising plate by a $25.00 fund-raising

 

20  donation, payment of the regular vehicle registration tax

 

21  prescribed under this act, and a $10.00 service fee. The

 

22  applicant must accompany an application for renewal of a fund-

 

23  raising plate by payment of the vehicle registration tax required

 

24  under section 801 and a $10.00 fund-raising donation. The

 

25  applicant must accompany an application for a replacement fund-

 

26  raising plate with payment of only the fee prescribed under

 

27  section 804.

 


 1        (3) The secretary of state may issue a personalized fund-

 

 2  raising plate upon application and the payment of the

 

 3  personalized registration plate fee prescribed under section 803b

 

 4  in addition to the fees and donations prescribed under subsection

 

 5  (2) and the regular vehicle registration tax prescribed under

 

 6  this act.

 

 7        (4) A disabled person or totally disabled veteran who

 

 8  applies for a fund-raising plate under this section and who pays

 

 9  the required service fees shall be issued, as determined by the

 

10  secretary of state, a disabled person's plate as provided in

 

11  section 803d for his or her fund-raising plate. The secretary of

 

12  state shall require the same proof that the applicant is a

 

13  disabled person as is required for issuance of a permanent

 

14  windshield placard under section 675. The secretary of state

 

15  shall require the same proof that the applicant is a totally

 

16  disabled veteran as is required for issuance of a special

 

17  registration plate under section 803d(2).

 

18        (5) A fund-raising plate expires as provided in section 226.

 

19  The secretary of state may issue a tab or tabs designating the

 

20  month and year of expiration for an original or renewal fund-

 

21  raising plate.

 

22        (6) The secretary of state may issue a temporary

 

23  registration permit to a person who submits an application and

 

24  the proper fees and donation for a fund-raising plate, if the

 

25  applicant's current vehicle registration will expire before his

 

26  or her receipt of a fund-raising plate. The temporary

 

27  registration expires upon the applicant's receipt of a fund-

 


 1  raising plate or upon the expiration of 60 days after the date of

 

 2  issuance, whichever occurs first. The secretary of state shall

 

 3  issue the temporary permit without a separate fee.
