A BILL FOR AN ACT

 

 

RELATING TO THE LANDLORD TENANT CODE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 521, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:

     "§521-    Eviction; failure to pay rent; removal of personalty; disposal of property.  (a)  Whenever a tenant has quit a premises pursuant to a notice to quit for failure to pay rent or a landlord has been awarded possession by a court under section 521-68(a), a landlord shall provide the tenant with access to the dwelling unit for a period of twenty-four hours solely for the purpose of removal of the tenant's personalty.

     (b)  If a tenant fails to remove and dispose of the tenant's personalty within twenty-four hours as provided in subsection (a), the personalty shall be deemed abandoned and the landlord may immediately dispose of the tenant's personalty."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon a date to be determined.



 

Report Title:

Landlord Tenant Code; Failure to Pay Rent; Removal and Disposal of Property

 

Description:

Requires a landlord to provide tenant access to a dwelling unit for a period of 24 hours solely for removal of the tenant's possessions when the tenant quits the premises or fails to pay rent.  Provides that after the 24-hour period, the tenant's property shall be deemed abandoned and may be immediately disposed.  (HB1009 HD1)
