A BILL FOR AN ACT

 

 

relating to motor vehicles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that parked motor vehicles that do not display valid registration or safety inspection stickers or are otherwise illegally parked are a persistent problem for Hawaii's communities.  The legislature further finds that many of these motor vehicles occupy the increasingly rare free parking spaces throughout the State.  Thus, any unnecessary delays in removing these motor vehicles adversely affects law-abiding residents of the State.

     Accordingly, the purpose of this Act is to authorize the department of transportation and each county police department to immediately tow any parked motor vehicle that is not properly registered, does not have a valid certificate of title, or is otherwise illegally parked.

     SECTION 2.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XV to be appropriately designated and to read as follows:

     "§291C-     Immediate motor vehicle towing.  Notwithstanding any law to the contrary, the department of transportation and the county police departments shall immediately cause to be towed away any parked motor vehicle that is not properly registered or does not display a valid safety inspection sticker or is otherwise parked or stopped in violation of any state traffic law."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
