A BILL FOR AN ACT

 

 

relating to offenses against public order.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that enhanced penalties are appropriate and necessary for certain offenses occurring on a public transit vehicle, or at or within a public transit facility, to protect users of public transit services.

     SECTION 2.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711-     Offenses on public transit vehicles and at public transit facilities.  (1)  When a person commits the offense of:

     (a)  Assault in the third degree as defined in section 707‑712;

     (b)  Terroristic threatening in the second degree as defined in section 707-717;

     (c)  Sexual assault in the fourth degree as defined in section 707-733;

     (d)  Criminal property damage in the third degree as defined in section 708-822;

     (e)  Criminal property damage in the fourth degree as defined in section 708-823;

     (f)  Theft in the third degree as defined in section 708‑832;

     (g)  Theft in the fourth degree as defined in section 708‑833;

     (h)  Arson in the fourth degree as defined in section 708‑8254;

     (i)  Disorderly conduct as defined in section 711-1101;

     (j)  Harassment as defined in section 711-1106; or

     (k)  Harassment by stalking as defined in section 711‑1106.5;

on a public transit vehicle, or at or within a public transit facility, the offense is a class C felony.

     (2)  As used in this section:

     (a)  "Public transit facility" means any defined land, property, structure, or equipment, including any stop or station on a public transportation route, that has as its primary purpose the operation or support of a public transit vehicle, or the provision of services to the passengers on a public transit vehicle.

     (b)  "Public transit vehicle" has the same meaning as in section 711-1112."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
