     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 488a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 488a. An employee or agent of the register of deeds who

 

records, provides a copy, or performs a search for a document

 

relating to an interest in real or personal property and who either

 

willfully fails to collect a fee for that service, unless the fee

 

has been waived by the register of deeds or by the register of

 

deeds' designee, or who appropriates the fee to his or her own use

 

is guilty of a felony punishable by imprisonment for not more than

 

3 years or a fine of not more than $5,000.00, or both.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
