AN ACT to amend the election law, in relation to the number of polling sites for early voting in certain cities and towns

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. Paragraph (a) of subdivision 2 of section 8-600 of the 2 election law, as amended by chapter 344 of the laws of 2020, is amended 3 to read as follows: 4 (a) The board of elections shall designate polling places for early 5 voting, which may include the offices of the board of elections, for 6 persons to vote early pursuant to this title; provided, however, that 7 the municipality with the highest population in each county based on the 8 latest federal decennial census shall have at least one polling place 9 designated for early voting, and to the extent practicable if such muni- 10 cipality has public transportation routes, such polling place shall be 11 situated along such transportation routes. There shall be so designated 12 at least one early voting polling place for every full increment of 13 fifty thousand registered voters in each county; provided, however, the 14 number of early voting polling places in a county shall not be required 15 to be greater than ten unless required by any other provision of law, 16 and a county with fewer than fifty thousand voters shall have at least 17 one early voting polling place. 18 In cities or towns with a population of more than one hundred thou- 19 sand, but less than one million based on the latest federal decennial 20 census, there shall be at least one early voting polling place for every 21 full increment of fifty thousand persons in such cities and towns based 22 on the latest federal decennial census; provided, however, the number of 23 early voting polling places in each such city and town shall not be 24 required to be greater than eleven, and to the extent practicable, if 25 such cities or towns have public transportation routes, such polling 26 places shall be situated along such transportation routes. 27 ยง 2. This act shall take effect immediately.
