A BILL FOR AN ACT

 

 

relating to condominiums.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 514B, Hawaii Revised Statutes, is amended by adding a new section to subpart B of part VI to be appropriately designated and to read as follows:

     "§514B-     Managing agent; election duties; verification of proxy authority.  The managing agent of an association shall be responsible for verifying:

     (1)  The eligibility of each member who runs for election to a position on the association's board of directors; and

     (2)  The authority of each proxy executed by a unit owner.

In fulfilling responsibilities under this section, the managing agent shall adhere to uniform and objective standards and criteria, as approved by the association's board of directors."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
