A BILL FOR AN ACT

 

 

relating to safety equipment.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new subpart to part II to be appropriately designated and to read as follows:

"   .  Athletic equipment

     §302A-A  Football helmet safety requirements.  (a)  Each department school shall ensure that each non-new football helmet used in that school's football program is reconditioned and recertified at least once every two years.

     (b)  At the start of each football game played, the department school's football team shall present each player's helmet to the applicable official referee of the game for inspection.  If the referee determines that a helmet has not been properly recertified in conformance with this section, the referee shall retain the helmet until the game has ended; provided that the team member to whom the helmet is assigned shall be prohibited from participating in that game; provided further that if the referee determines that three or more helmets fail to conform to the requirements of this section at the start of a single game, the department school shall be fined not less than $300 but no more than $500 per game, depending on the number of helmets in violation of this section.

     (c)  Any fines collected pursuant to subsection (b) shall be:

     (1)  Due and payable within thirty days; and

     (2)  Deposited into the football helmet recertification special fund.

     (d)  As used in this section:

     "Recertification" means the process of reconditioning, testing, and properly labeling helmets and other athletic equipment that meet the original performance standards for that equipment.

     "Reconditioning" means the process of inspecting, cleaning, sanitizing, repairing, and restoring helmets and other athletic equipment to meet the original performance standards for that equipment.

     "Referee" means the head official in charge of monitoring a particular football game.

     §302A-B  Football helmet recertification special fund.  (a)  There is established within the state treasury a football helmet recertification special fund to be administered by the department and into which shall be deposited all moneys collected pursuant to section 302A-A.

     (b)  Moneys deposited into the football helmet recertification special fund may be expended by the department for costs and expenses related to the administration and operation of athletic programs at department schools."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  This Act shall take effect on July 1, 2020.
