By: Canales H.B. No. 3741       A BILL TO BE ENTITLED   AN ACT   relating to the regulation by the Texas Department of   Transportation of right-of-way landscaping.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter C, Chapter 202, Transportation Code,   is amended by adding Section 202.062 to read as follows:          Sec. 202.062.  VEGETATION IN RIGHT-OF-WAY. (a) The   department shall institute a program for landowners with property   adjacent to the state highway system allowing the planting or   replacement of existing vegetation in the right-of-way that affects   their property.          (b)  a landowner who installs right-of-way vegetation must   only use plants that are native, regionally appropriate, and   pollinator-friendly.          SECTION 2.  This Act takes effect September 1, 2023.
