     A bill to amend 1968 PA 330, entitled

 

"Private security business and security alarm act,"

 

by amending sections 17a and 37a (MCL 338.1067a and 338.1087a),

 

section 17a as added by 2012 PA 591 and section 37a as added by

 

2016 PA 324.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 17a. (1) If Except as provided in subsection (2), if a

 

private security guard, private security police officer, or private

 

college security force officer acting in the course of his or her

 

employment reasonably suspects that any of the following crimes

 

have occurred, he or she shall immediately notify a law enforcement

 

agency of that suspected crime:

 


     (a) An assaultive crime, as defined in section 9a of chapter X

 

of the code of criminal procedure, 1927 PA 175, MCL 770.9a.

 

     (b) A violation of section 145c or 539j of the Michigan penal

 

code, 1931 PA 328, MCL 750.145c and 750.539j.

 

     (2) A private college security officer sworn and fully

 

empowered under section 37a shall notify the campus crime

 

commission if in the course of his or her employment the private

 

college security officer receives information that first or second

 

degree murder, domestic violence, or a crime involving sexual

 

violence or contact, or assault with a weapon, has occurred on

 

property owned or leased by the private college or university. If

 

otherwise granted the authority under this act, a private college

 

security officer may conduct a preliminary investigation and take

 

action on the information before providing the notice required

 

under this subsection.

 

     (3) A private college security officer who willfully neglects

 

to perform the duty required under subsection (2) is guilty of a

 

misdemeanor punishable by imprisonment for not more than 90 days or

 

a fine of not more than $1,000.00, or both.

 

     (4) As used in this section and section 37a, "domestic

 

violence" means a violation of section 81(2), (3), (4), or (5) of

 

the Michigan penal code, 1931 PA 328, MCL 750.81.

 

     Sec. 37a. (1) A private college security officer appointed

 

under section 37 may be sworn and fully empowered by the chief of

 

police of a village, city, or township law enforcement agency, or

 

deputized by a sheriff as a deputy sheriff, excluding deputation as

 

a special deputy, as provided in under section 9d of the Michigan


commission on law enforcement standards act, 1965 PA 203, MCL

 

28.609d.

 

     (2) A Except as provided in subsection (3), a private college

 

security officer sworn and fully empowered as provided in this

 

section may exercise the authority and power of a peace officer as

 

prescribed in an oath of office administered by a chief of police

 

of a village, city, or township law enforcement agency, or county

 

sheriff, as provided in under section 9d of the Michigan commission

 

on law enforcement standards act, 1965 PA 203, MCL 28.609d.

 

     (3) Except for the investigation and action described in

 

section 17a(2), a private college security officer described in

 

subsection (2) may only investigate first or second degree murder,

 

domestic violence, or crimes involving sexual violence or contact,

 

or assault with a weapon, in consultation with the campus crime

 

commission as provided in the campus crime investigation act.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No.____ (request no.

 

05654'18 *) of the 99th Legislature is enacted into law.
