AN ACT

 

amending Title 36, chapter 18, article 1, Arizona Revised Statutes, by adding section 36-2007; relating to behavioral health treatment services.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 18, article 1, Arizona Revised Statutes, is amended by adding section 36-2007, to read:

START_STATUTE36-2007.  Community treatment and safety fund; appropriation; purpose; administration; exemption

A.  The Community treatment and safety fund is established. The department shall administer the fund. Monies in the fund are continuously APPROPRIATED for the purposes provided in this section. The department may use up to ten percent of the monies deposited in the fund in each fiscal year for administrative costs.

B.  The sum of $5,000,000 is appropriated from the state general fund in each fiscal year to the Community treatment and safety fund.

C.  The department shall:

1.  Analyze each county with a population of less than one million persons to determine which behavioral health treatment services are AVAILABLE in that county and to identify significant gaps in the AVAILABILITY of those services in that county.

2.  Based on the analysis required by paragraph 1 of this subsection, award grants pursuant to Title 41, chapter 24 to expand treatment programs provided by nonprofit behavioral health treatment providers for persons in counties with a population of less than one million persons who are either:

(a)  in court-ordered substance abuse treatment programs.

(b)  in state department of corrections community supervision programs.

(c)  On probation.

D.  The behavioral health treatment services that are eligible for grant awards pursuant to this section include:

1.  Cognitive behavioral therapy.

2.  Family Therapy.

3.  Couples therapy.

4.  Group counseling.

5.  Individual counseling.

6.  Psychosocial interventions.

7.  Post-traumatic stress disorder treatment.

8.  Substance abuse and chemical DEPENDENCY treatment.

E.  Monies in the Community treatment and safety fund are exempt from the provisions of section 35-190 relating to lapsing of appropriations. END_STATUTE
