Alcoholic beverages: licensees.
Existing law, the Alcoholic Beverage Control Act, is administered by the Department of Alcoholic Beverage Control to prohibit unlicensed manufacturing, selling, and disposing of alcoholic beverages, among other things. Under existing law, the holder of a license to sell alcoholic beverages is subject to criminal prosecution and suspension or revocation of that license if the licensee sells any alcoholic beverages to any person under 21 years of age. Existing law authorizes the licensee to refuse to sell or serve alcoholic beverages to any person unable to produce adequate written evidence that he or she is over 21 years of age. Under existing law, a violation of the Alcoholic Beverage Control Act is a misdemeanor, as provided.
This bill would require the licensee to refuse to sell or serve alcoholic beverages to any person unable to provide
adequate written evidence that he or she is over 21 years of age. By imposing a new requirement on a licensee under the Alcoholic Beverage Control Act, the violation of which would be a crime, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.
