HOUSE BILL No. 6295

     A bill to prohibit a local unit of government from enacting or

 

enforcing an ordinance or rule that regulates a dog or service

 

animal based on the breed, perceived breed, or a physical

 

characteristic of a breed; and to provide for the powers and duties

 

of certain local governmental entities.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) A local unit of government shall not enact or

 

enforce an ordinance or rule that regulates a dog or service animal

 

based on the breed, perceived breed, or a physical characteristic

 

of a breed.

 

     (2) This act does not prohibit a local unit of government from

 

enacting an ordinance or rule that places restrictions or imposes


additional requirements on dogs or dog owners.

 

     (3) As used in this act:

 

     (a) "Dog" means a domestic dog of any age of the species Canis

 

familiaris.

 

     (b) "Local unit of government" means a county, city, village,

 

or township.

 

     (c) "Service animal" means all of the following:

 

     (i) That term as defined in 28 CFR 36.104.

 

     (ii) A miniature horse that has been individually trained to

 

do work or perform tasks as described in 28 CFR 36.104 for the

 

benefit of a person with a disability.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
