A BILL FOR AN ACT

 

 

relating to solid waste management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 37, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§37-     General revenues; solid waste management; set aside for research and development.  The director of finance shall deposit one per cent of all general revenues collected by the State during each fiscal year into the solid waste management research and development special fund established by section 342G-   ; provided that the director of finance shall make deposits into the solid waste management research and development special fund at least once per fiscal quarter."

     SECTION 2.  Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§342G-     Solid waste management research and development special fund; established.  (a)  There is established in the state treasury the solid waste management research and development special fund, into which shall be deposited:

     (1)  One per cent of all general revenues of the State collected each fiscal year pursuant to section 37-   ;

     (2)  Appropriations made by the legislature to the fund; and

     (3)  Gifts, donations, and grants from public agencies and private persons.

     (b)  All interest earned or accrued on moneys deposited in the fund shall become part of the fund.

     (c)  The department shall expend moneys contained in the solid waste management research and development special fund only on research and development programs that will assist in the State's management of solid waste.

     (d)  No later than twenty days prior to the convening of the regular session of each odd-numbered year, the department shall submit a report to the legislature that includes:

     (1)  An accounting of all income and expenditures of the solid waste management research and development special fund during the preceding fiscal year;

     (2)  The fund's balance as of June 30 of the preceding fiscal year;

     (3)  A description of all research and development projects funded by the solid waste management research and development special fund, including a description of all applicable contracts entered into and all results achieved from the research and development;

     (4)  A plan for how moneys in the solid waste management research and development special fund will be spent in the next fiscal biennium; and

     (5)  Any other findings and recommendations, including any proposed legislation."

     SECTION 3.  There is appropriated out of the general revenues of the State the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 to be deposited into the solid waste management research and development special fund.

     SECTION 4.  There is appropriated out of the solid waste management research and development special fund the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for research and development into solid waste management.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 5.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2020.
