SENATE BILL No. 952

     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

by amending section 317a (MCL 750.317a), as added by 2005 PA 167.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 317a. (1) A person who delivers a schedule 1 or 2

 

controlled substance, other than marihuana, to another person in

 

violation of section 7401 of the public health code, 1978 PA 368,

 

MCL 333.7401, that is consumed by that person or any other person

 

and that causes the death of that person or other person is guilty

 

of a felony punishable by imprisonment for life or any term of

 

years.

 

     (2) A violation of this section may be prosecuted in the

 

county in which any of the following occurred:

 

     (a) The county in which delivery of the controlled substance

 


was made.

 

     (b) The county in which the controlled substance was consumed.

 

     (c) The county in which the death caused by the delivery of

 

the controlled substance occurred.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No.____ (request no.

 

05611'17 a) of the 99th Legislature is enacted into law.
