A BILL FOR AN ACT

 

 

RELATING TO PUBLIC-PRIVATE PARTNERSHIPS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The department of business, economic development, and tourism is authorized to establish and fill one permanent state public-private partnership coordinator position, exempt from chapter 76, Hawaii Revised Statutes, to be placed under the director of business, economic development, and tourism to manage all public-private partnerships entered into by the State and manage all contracts, proposals, and negotiations associated with the State's public-private partnerships.  Public-private partnerships entered into by the Hawaii public housing authority are exempt from this part.

PART II

     SECTION 2.  Chapter 201, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART    .  OFFICE OF PUBLIC-PRIVATE PARTNERSHIP

     §201-    Office of public-private partnership; established.  There is established within the department of business, economic development, and tourism an office of public-private partnership to increase economic development in the State through collaboration between the public and private sectors.

     §201-    Duties.  The office of public-private partnership shall:

     (1)  Create a strategic plan that includes:

         (A)  Objectives and goals for the office and criteria to measure the goals;

         (B)  Potential public-private projects that meet the office's objectives and goals;

         (C)  The necessary finances to establish and maintain the office; and

         (D)  The necessary finances to develop, implement, and maintain the potential public-private projects;

     (2)  Coordinate collaboration among state agencies to analyze and develop public-private partnership projects based on the needs and goals of the agency and State;

     (3)  Create and maintain an analysis report for each public-private partnership project that shall include:

         (A)  Proposed economic benefits;

         (B)  Potential financial outcomes;

         (C)  Contract terms and conditions; and

         (D)  Social benefits;

     (4)  In collaboration with agencies and private businesses, oversee and implement each public-private project; and

     (5)  Initiate Aloha Stadium redevelopment as its initial public-private partnership project."

PART III

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $10,000,000 or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to:

     (1)  Establish and fill the state public-private partnership coordinator position pursuant to part I of this Act; provided that the position may be added to the position count for the department of business, economic development, and tourism; and

     (2)  Establish and operate the office of public-private partnership and initiate Aloha Stadium redevelopment pursuant to part II of this Act.

     The sumsappropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2038.

Description:

Authorizes establishment of a State Public-Private Partnership Coordinator position within the department of business, economic development, and tourism to manage public-private partnerships entered into by the State and associated contracts, proposals, and negotiations, except public-private partnerships entered into by Hawaii public housing authority.  Establishes an office of public-private partnership within the department of business, economic development, and tourism.  Requires that the office create a strategic plan; create collaboration amongst state agencies to identify and implement public-private projects; and oversee and implement the public-private projects.  Appropriates funds to establish and fill the state public-private partnership coordinator position, establish and operate the office of public-private partnership, and initiate Aloha Stadium redevelopment.  Effective 7/1/2038.  (SD1)
