AN ACT

 

Amending title 36, chapter 4, article 1, Arizona Revised Statutes, by adding section 36‑420; relating to health care institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 36-420, to read:

START_STATUTE36-420.  Health care institutions; duty to care for residents; requirements; prohibition

A.  All health care institutions licensed pursuant to this title which provide congregant or residential care shall provide cardiopulmonary resuscitation training for all staff as prescribed in rule by the department.  Facility staff who are certified in cardiopulmonary resuscitation shall be available at all times.

B.  Facilities prescribed in subsection A of this section Shall establish and implement policies that require facility staff to immediately evaluate the condition and circumstances of any resident who experiences cardiac arrest or any other cessation of respiration and determine if immediate resuscitation is feasible and appropriate in accordance with that resident's advance directives or do‑not‑resuscitate order. Facilities shall not implement a policy which prevents staff from providing immediate resuscitation which complies with this subsection.

C.  A facility and its staff who in good faith renders emergency care or emergency assistance to a person who experiences cardiac arrest or any other cessation of respiration or is not liable for any civil damages as the result of any act or omission by the person rendering the emergency care or emergency assistance to the person, unless the person acted with gross negligence while rendering the emergency care or emergency assistance.
